A bill for an act
relating to agriculture; requiring treated seeds reports and record keeping;
amending Minnesota Statutes 2014, section 21.84.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 21.84, is amended to read:


21.84 RECORDS; TREATED SEEDS REPORTING.

Subdivision 1.

Records.

(a) Each person whose name appears on the label of
agricultural, vegetable, flower, wildflower, tree, or shrub seeds subject to section 21.82 or
21.83 shall keep for three years complete records of each lot of agricultural, vegetable,
flower, wildflower, tree, or shrub seed sold in this state and shall keep for one year a file
sample of each lot of seed after disposition of the lot.

(b) Each person who sells at retail or provides to an end user agricultural, vegetable,
flower, wildflower, tree, or shrub seeds subject to section 21.82 or 21.83 shall keep for
three years complete records of each lot of agricultural, vegetable, flower, wildflower, tree,
or shrub seed sold in this state.

Subd. 2.

Treated seeds reporting.

(a) Each person required to keep records
under paragraph (a) and who sells or provides to an end user agricultural seeds that are
treated with imidacloprid, thiamethoxam, or clothianidin must annually report to the
commissioner with the following information regarding the treated agricultural seeds:

(1) copies of invoices that include:

(i) the lot number of the treated agricultural seeds sold;

(ii) the amount of treated agricultural seeds sold;

(iii) the sale date of the treated agricultural seeds; and

(iv) the name and address of the buyer of the treated agricultural seeds; and

(2) a copy of the treated agricultural seeds label.

(b) The report required under this subdivision must be filed by January 31 for the
previous year's sales. The commissioner shall specify the method for submittal of the report.

(c) The information contained in the reports in this subdivision is private data.

EFFECTIVE DATE.

This section is effective the day following final enactment.
Initial reports required under this section must first be filed by January 31, 2017, for sales
of treated agricultural seeds during calendar year 2016.
