1.1A bill for an act
1.2relating to finance; appropriating money to continue operations of a state agency
1.3if the major appropriation bill to fund that agency has not been enacted by July
1.41, 2009.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. CONTINUING APPROPRIATIONS.
1.7    Subdivision 1. Appropriations. If a major appropriation bill to fund a given state
1.8agency for the biennium beginning July 1, 2009, has not been enacted by that date,
1.9amounts sufficient to continue operation of that agency and the programs administered
1.10by that agency through the fiscal year ending June 30, 2010, at the base level for that
1.11fiscal year, as determined and adjusted according to Minnesota Statutes, section 16A.11,
1.12subdivision 3, and previous appropriation acts, are appropriated to the agency from the
1.13appropriate funds and accounts in the state treasury. The base level for an appropriation
1.14that was designated as onetime or was onetime in nature is zero.
1.15    Subd. 2. Legislative advisory commission. (a) The appropriations under
1.16subdivision 1 must not be reduced below the base level, except as required to balance
1.17expenditures with revenue and after consultation with the Legislative Advisory
1.18Commission as required by Minnesota Statutes, section 16A.152, subdivision 4.
1.19(b) Federal fiscal stabilization money received by the state under title XIV of the
1.20American Recovery and Reinvestment Act of 2009, Public Law 111-5, division A, must
1.21not be spent except pursuant to a direct appropriation by law. Other federal money
1.22received under Public Law 111-5 that has not been appropriated by a law enacted by the
1.2386th Legislature and for which further review was requested under Minnesota Statutes,
1.24section 3.3005, subdivision 2a, may not be allotted for expenditure except in accordance
2.1with the procedure for review by the Legislative Advisory Commission under Minnesota
2.2Statutes, section 3.3005, subdivision 5.

2.3    Sec. 2. EFFECTIVE DATE.
2.4Section 1 is effective the day following final enactment.
