A bill for an act
relating to data practices; classifying law enforcement surveillance technology;
amending Minnesota Statutes 2014, section 13.82, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 13.82, is amended by adding a subdivision
to read:

new text begin Law enforcement surveillance technology. new text end

new text begin (a) As used in this
subdivision, "law enforcement surveillance technology" includes any device used by a law
enforcement agency to electronically capture an audio, video, or photographic record of
the activities of the general public, or of an individual or group of individuals, for purposes
of conducting an investigation, responding to an incident or request for service, monitoring
or maintaining public order and safety, or engaging in any other law enforcement function
authorized by law. "Law enforcement surveillance technology" includes, but is not limited
to, the use of body cameras, dashboard cameras, automated image capture devices, drones
and other similar unmanned aircraft systems, and facial or biometric recognition devices.

new text begin (b) Notwithstanding any other law to the contrary, unless exempted by specific
reference to this section, all data collected through use of law enforcement surveillance
technology is private data on individuals and may only be used in the course of an active
criminal investigation or, upon authorization by court order, for purposes relating to
investigation of alleged misconduct by a law enforcement officer or crimes committed
against a law enforcement officer in the course of duty.
