A bill for an act
relating to public safety; expanding fourth-degree assault protections to code
enforcement officers; amending Minnesota Statutes 2014, section 609.2231,
subdivision 6.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 609.2231, subdivision 6, is amended to read:


Subd. 6.

Public employeesnew text begin and agentsnew text end with mandated duties.

guilty of a gross misdemeanor who:

(1) assaults deleted text begin an agricultural inspector, occupational safety and health investigatordeleted text end new text begin a
code enforcement officer
new text end , child protection worker, public health nurse, deleted text begin animal control
officer,
deleted text end or probation or parole officer while the employeenew text begin or agentnew text end is engaged in the
performance of a duty mandated by law, court order, or ordinance;

(2) knows that the victim is a public employeenew text begin or agentnew text end engaged in the performance
of the official public duties of the office; and

(3) inflicts demonstrable bodily harm.

new text begin (b) For purposes of this subdivision, "code enforcement officer" means an individual
who is an employee or agent of the state or a political subdivision of the state and is
authorized to conduct regulatory inspections or enforce regulatory laws, ordinances,
or rules, including but not limited to building standards and codes, fire codes, housing
maintenance codes, animal care and control, land use regulation, traffic control, health and
food codes, occupational safety codes, noxious weed laws, environmental regulations,
or business and trades licensing.
