1.2relating to the Washington County Housing and Redevelopment Authority;
1.3clarifying the jurisdiction of the authority;amending Laws 1974, chapter 475,
1.4sections 1; 2, subdivision 1; 3.
1.5BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.6    Section 1. Laws 1974, chapter 475, section 1, is amended to read:
1.7    Section 1. WASHINGTON COUNTY; HOUSING AND REDEVELOPMENT
1.8AUTHORITY.
1.9There is hereby created in Washington county a public body corporate and politic,
1.10to be known as the Washington County Housing and Redevelopment Authority, having
1.11all the powers and duties of a housing and redevelopment county authority under
1.12the provisions of the municipal housing and redevelopment act, Minnesota Statutes,
1.13sections 462.411 to 462.711, and acts amendatory thereof; which act applies 469.001 to
1.14469.047, and all powers of a county housing and redevelopment authority under any other
1.15provisions of Minnesota law, and Minnesota Statutes, sections 469.001 to 469.047 apply
1.16to the county of Washington. For the purposes of applying the provisions of the municipal
1.17housing and redevelopment act to Washington county, the county has all of the powers and
1.18duties of a municipality, the county board has all of the powers and duties of a governing
1.19body, the chairman of the county board has all the powers and duties of a mayor, and the
1.20area of operation includes the area within the territorial boundaries of the county.
1.21EFFECTIVE DATE.This section is effective the day after the governing body of
1.22Washington County and its chief clerical officer timely complete their compliance with
1.23Minnesota Statutes, section 645.021, subdivisions 2 and 3.

2.1    Sec. 2. Laws 1974, chapter 475, section 2, subdivision 1, is amended to read:
2.2    Subdivision 1. This act shall not limit or restrict any existing housing and
2.3redevelopment authority or prevent a municipality from creating an authority. The
2.4county shall not exercise jurisdiction in any municipality where a municipal housing and
2.5redevelopment authority is established. The jurisdiction and area of operation of the
2.6Washington County Housing and Redevelopment Authority includes all of the area within
2.7the territorial boundaries of the county and includes the areas within the boundaries of
2.8every city in the county and the area of operation of city housing and redevelopment
2.9authorities in the county, whenever created, and notwithstanding any provision of
2.10Minnesota Statutes, section 469.005, subdivision 1, or 469.008, subject, however, to
2.11section 3. The jurisdiction and area of operation of the Washington County Housing and
2.12Redevelopment Authority is not affected by any concurrence by the Washington County
2.13Housing and Redevelopment Authority under Minnesota Statutes, section 469.004,
2.14subdivision 5.
2.15EFFECTIVE DATE.This section is effective the day after the governing body of
2.16Washington County and its chief clerical officer timely complete their compliance with
2.17Minnesota Statutes, section 645.021, subdivisions 2 and 3.

2.18    Sec. 3. Laws 1974, chapter 475, section 3, is amended to read:

2.19    Sec. 3. MUNICIPAL APPROVAL.
2.20If any housing or redevelopment project is undertaken in Washington county
2.21pursuant to this authorization, and such the project is within the boundaries of any
2.22incorporated village, statutory or home rule charter city or township, the project and the
2.23location of such the project shall be approved subject to approval by the governing body
2.24of such village, the city, or township. The procedures in Minnesota Statutes, section
2.25469.007, subdivision 2, shall apply to the governing body project and location approvals
2.26required by this section.
2.27EFFECTIVE DATE.This section is effective the day after the governing body of
2.28Washington County and its chief clerical officer timely complete their compliance with
2.29Minnesota Statutes, section 645.021, subdivisions 2 and 3.

2.30    Sec. 4. PRIOR ACTIVITIES.
2.31Sections 1, 2, and 3 are, in part, remedial in nature. Actions of Washington County
2.32or the Washington County Housing and Redevelopment Authority prior to the effective
3.1date of those sections are not invalid or unenforceable for exercising powers that are
3.2authorized by sections 1, 2, and 3.
3.3EFFECTIVE DATE.This section is effective the day following final enactment.
