  1.1                          A bill for an act 
  1.2             relating to government data practices; collection and 
  1.3             dissemination of data; proposing classifications of 
  1.4             data as private and nonpublic; amending Minnesota 
  1.5             Statutes 2002, sections 13.3805, by adding a 
  1.6             subdivision; 13.44, by adding a subdivision; proposing 
  1.7             coding for new law in Minnesota Statutes, chapter 13. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [13.203] [SERVICE COOPERATIVE CLAIMS DATA.] 
  1.10     Claims experience and all related information received from 
  1.11  carriers and claims administrators participating in a group 
  1.12  health or dental plan, including any long-term disability plan, 
  1.13  offered through the Minnesota service cooperatives to Minnesota 
  1.14  school districts and other political subdivisions, and survey 
  1.15  information collected from employees and employers participating 
  1.16  in these plans and programs, except when the executive director 
  1.17  of a Minnesota service cooperative determines that release of 
  1.18  the data will not be detrimental to the plan or program, are 
  1.19  classified as nonpublic data not on individuals. 
  1.20     Sec. 2.  Minnesota Statutes 2002, section 13.3805, is 
  1.21  amended by adding a subdivision to read: 
  1.22     Subd. 3.  [INACTIVE INVESTIGATIVE DATA; OFFICE OF HEALTH 
  1.23  FACILITY COMPLAINTS.] All inactive investigative data on 
  1.24  individuals that are maintained by the Office of Health Facility 
  1.25  and Complaints and are not classified under section 626.557, are 
  1.26  classified as private data on individuals. 
  2.1      Sec. 3.  Minnesota Statutes 2002, section 13.44, is amended 
  2.2   by adding a subdivision to read: 
  2.3      Subd. 4.  [PERSONAL AND INTANGIBLE PROPERTY; APPRAISAL 
  2.4   DATA.] Preliminary and final market value appraisals, which are 
  2.5   made by personnel of a city or by an independent appraiser 
  2.6   acting on behalf of a city, of personal and intangible property 
  2.7   owned by the city, are classified as nonpublic data not on 
  2.8   individuals until either (1) a purchase agreement is entered 
  2.9   into; or (2) the parties negotiating the transaction exchange 
  2.10  appraisals.
