A bill for an act
proposing an amendment to the Minnesota Constitution
by adding a section to article VI; restricting the
judicial power to define marriage.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

An amendment to the Minnesota Constitution is proposed to
the people. If the amendment is adopted, a section shall be
added to article VI, to read:

Sec. 14. The judicial power of this state does not include
the power to define the gender of parties who may enter into a
civil contract of marriage. The gender of parties who may enter
into a civil contract of marriage must be defined by law as
enacted by the legislature.

The proposed amendment shall be submitted to the people at
the 2008 general election. The question submitted shall be:

"Shall the Minnesota Constitution be amended to provide
that the gender of parties who may enter into a civil contract
of marriage must be defined by law and that the judicial power
of this state does not include the power to define the gender of
parties who may enter into a civil contract of marriage except
as provided by law enacted by the legislature?
