1.16BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.17ARTICLE 1
1.18EDUCATION PROVISIONS

1.19    Section 1. [16A.1524] APPROPRIATION REDUCTION AND SCHOOL AID
1.20PAYMENT PERCENTAGE INCREASE.
1.21    Subdivision 1. General fund appropriation reduction. By July 15 of each
1.22fiscal year, the commissioner of management and budget shall reduce all general fund
1.23appropriations by one percent and cancel that amount to the general fund.
1.24    Subd. 2. Exemptions. Appropriations made to the commissioner of education and
1.25the appropriation under section 16A.641 are exempt from subdivision 1.
1.26    Subd. 3. Increase in school aid payment percentage. If the current year aid
1.27payment percentage under section 127A.45 is less than 90 percent, by July 31 of each
1.28fiscal year the commissioner of management and budget shall certify to the commissioner
2.1of education the total amount of the general fund appropriation reductions under
2.2subdivision 1. The commissioner of education shall increase the aid payment percentage
2.3to not more than 90 percent rounded to the nearest tenth of a percent by the certified
2.4amount for that fiscal year and thereafter. The amounts necessary to meet this requirement
2.5are appropriated from the general fund to the commissioner of education.
2.6EFFECTIVE DATE.This section is effective July 1, 2013.

2.7    Sec. 2. Minnesota Statutes 2011 Supplement, section 123B.54, is amended to read:
2.8123B.54 DEBT SERVICE APPROPRIATION.
2.9    (a) $11,022,000 in fiscal year 2012, $19,484,000 in fiscal year 2013, $23,588,000
2.10$22,402,000 in fiscal year 2014, and $23,967,000 $24,539,000 in fiscal year 2015 and
2.11later are appropriated from the general fund to the commissioner of education for payment
2.12of debt service equalization aid under section 123B.53.
2.13    (b) The appropriations in paragraph (a) must be reduced by the amount of any
2.14money specifically appropriated for the same purpose in any year from any state fund.

2.15    Sec. 3. Minnesota Statutes 2011 Supplement, section 127A.45, subdivision 2, is
2.16amended to read:
2.17    Subd. 2. Definitions. (a) "Other district receipts" means payments by county
2.18treasurers pursuant to section 276.10, apportionments from the school endowment fund
2.19pursuant to section 127A.33, apportionments by the county auditor pursuant to section
2.20127A.34, subdivision 2 , and payments to school districts by the commissioner of revenue
2.21pursuant to chapter 298.
2.22(b) "Cumulative amount guaranteed" means the product of
2.23(1) the cumulative disbursement percentage shown in subdivision 3; times
2.24(2) the sum of
2.25(i) the current year aid payment percentage of the estimated aid and credit
2.26entitlements paid according to subdivision 13; plus
2.27(ii) 100 percent of the entitlements paid according to subdivisions 11 and 12; plus
2.28(iii) the other district receipts.
2.29(c) "Payment date" means the date on which state payments to districts are made
2.30by the electronic funds transfer method. If a payment date falls on a Saturday, a Sunday,
2.31or a weekday which is a legal holiday, the payment shall be made on the immediately
2.32preceding business day. The commissioner may make payments on dates other than
2.33those listed in subdivision 3, but only for portions of payments from any preceding
3.1payment dates which could not be processed by the electronic funds transfer method due
3.2to documented extenuating circumstances.
3.3(d) The current year aid payment percentage equals 73 in fiscal year 2010 and 70 in
3.4fiscal year 2011, and 60 64.3 in fiscal years 2012 year 2012 and 70 in fiscal year 2013
3.5and later.
3.6(e) Notwithstanding paragraph (d), the current year aid payment percentage equals
3.7the amount in paragraph (d), as adjusted by section 16A.152, subdivision 2, or section
3.816A.1524.
3.9EFFECTIVE DATE.This section is effective July 1, 2012.

3.10    Sec. 4. Minnesota Statutes 2010, section 179A.20, subdivision 6, is amended to read:
3.11    Subd. 6. Contract in effect. During the period after contract expiration and prior to
3.12the date when the right to strike matures, and for additional time if the parties agree, the
3.13terms of an existing contract shall continue in effect and shall be enforceable upon both
3.14parties, except as provided in subdivision 6a for school districts.

3.15    Sec. 5. Minnesota Statutes 2010, section 179A.20, is amended by adding a subdivision
3.16to read:
3.17    Subd. 6a. Contract in effect; school districts. If a contract term would provide a
3.18wage or salary increase to an employee, including, but not limited to, an increase based on
3.19cost of living, longevity, education or training, or performance or merit, the contract term
3.20does not continue in effect and is not enforceable after the expiration date stated in the
3.21contract between a school district and the exclusive representative. The parties may not
3.22agree to extend or honor such a contract term beyond the expiration date of the contract.
3.23EFFECTIVE DATE.This section is effective the day following final enactment.
3.24For a collective bargaining agreement that expired before the effective date of this section,
3.25the requirements of this section apply to limit wages to the levels and amounts in effect on
3.26the effective date of this section.

3.27    Sec. 6. BALANCE CANCELED TO GENERAL FUND.
3.28$415,505,000 of the balance in the budget reserve account created in Minnesota
3.29Statutes, section 16A.152, subdivision 1a, is canceled to the general fund in fiscal year
3.302013.
