A bill for an act
relating to transportation; clarifying that coffee shop qualifies as restaurant in
determining eligibility for specific service sign; amending Minnesota Statutes
2006, sections 160.292, subdivision 19; 160.295, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 160.292, subdivision 19, is amended to
read:


Subd. 19.

Restaurant.

"Restaurant" has the meaning given it in section 157.15new text begin,
except that it includes a coffee shop. A coffee shop must sell as a principal commodity
coffee products for immediate consumption

Sec. 2.

Minnesota Statutes 2006, section 160.295, subdivision 3, is amended to read:


Subd. 3.

Motel, restaurant, and resort.

Motels, restaurants, and resorts served
by the specific service signing shall be licensed by the state Department of Health as
required by section 157.16. new text beginA restaurant that is a coffee shop is not subject to requirements
established by the commissioner requiring that food be prepared on the premises of the
business.
