A bill for an act
relating to transportation; clarifying that coffee shop qualifies as restaurant in
determining eligibility for specific service sign; amending Minnesota Statutes
2006, sections 160.292, subdivision 19; 160.295, subdivision 3.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2006, section 160.292, subdivision 19, is amended to
read:
"Restaurant" has the meaning given it in section 157.15new text begin ,
except that it includes a coffee shop. A coffee shop must sell as a principal commodity
coffee products for immediate consumptionnew text end .
Minnesota Statutes 2006, section 160.295, subdivision 3, is amended to read:
Motels, restaurants, and resorts served
by the specific service signing shall be licensed by the state Department of Health as
required by section 157.16. new text begin A restaurant that is a coffee shop is not subject to requirements
established by the commissioner requiring that food be prepared on the premises of the
business.
