  1.1                          A bill for an act
  1.2             relating to public contractors' performance bonds; 
  1.3             exempting certain manufacturers from requirements for 
  1.4             posting bonds; amending Minnesota Statutes 1994, 
  1.5             section 574.26, by adding a subdivision. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 574.26, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 1a.  [EXEMPTION; CERTAIN MANUFACTURERS.] Sections 
  1.10  574.26 to 574.32 do not apply to a manufacturer of public 
  1.11  transit buses that manufacture at least 100 public transit buses 
  1.12  in a calendar year.  For purposes of this section, "public 
  1.13  transit bus" means a motor vehicle designed to transport people, 
  1.14  with a design capacity for carrying more than 40 passengers, 
  1.15  including the driver.  The term "public transit bus" does not 
  1.16  include a school bus, as defined in section 169.01, subdivision 
  1.17  6. 
  1.18     Sec. 2.  [EFFECTIVE DATE.] 
  1.19     Section 1 is effective the day after final enactment.
