  1.1                          A bill for an act 
  1.2             relating to crime prevention; changing reimbursement 
  1.3             for soft body armor; providing for adjustment to the 
  1.4             public safety officer's death benefit; amending 
  1.5             Minnesota Statutes 1994, sections 299A.38, subdivision 
  1.6             2; and 299A.44. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 299A.38, 
  1.9   subdivision 2, is amended to read: 
  1.10     Subd. 2.  [STATE AND LOCAL REIMBURSEMENT.] Peace officers 
  1.11  and heads of local law enforcement agencies who buy vests for 
  1.12  the use of peace officer employees may apply to the commissioner 
  1.13  for reimbursement of funds spent to buy vests.  On approving an 
  1.14  application for reimbursement, the commissioner shall pay the 
  1.15  applicant an amount equal to the lesser of one-third one-half of 
  1.16  the vest's purchase price or $165 $300.  The political 
  1.17  subdivision that employs the peace officer shall pay at least 
  1.18  the lesser of one-third one-half of the vest's purchase price or 
  1.19  $165 $300.  The political subdivision may not deduct or pay its 
  1.20  share of the vest's cost from any clothing, maintenance, or 
  1.21  similar allowance otherwise provided to the peace officer by the 
  1.22  law enforcement agency. 
  1.23     Sec. 2.  Minnesota Statutes 1994, section 299A.44, is 
  1.24  amended to read: 
  1.25     299A.44 [DEATH BENEFIT.] 
  1.26     Subdivision 1.  [PAYMENT REQUIRED.] On certification to the 
  2.1   governor by the commissioner of public safety that a public 
  2.2   safety officer employed within this state has been killed in the 
  2.3   line of duty, leaving a spouse or one or more eligible 
  2.4   dependents, the commissioner of finance shall pay $100,000 from 
  2.5   the public safety officer's benefit account, as follows: 
  2.6      (1) if there is no dependent child, to the spouse; 
  2.7      (2) if there is no spouse, to the dependent child or 
  2.8   children in equal shares; 
  2.9      (3) if there are both a spouse and one or more dependent 
  2.10  children, one-half to the spouse and one-half to the child or 
  2.11  children, in equal shares; 
  2.12     (4) if there is no surviving spouse or dependent child or 
  2.13  children, to the parent or parents dependent for support on the 
  2.14  decedent, in equal shares; or 
  2.15     (5) if there is no surviving spouse, dependent child, or 
  2.16  dependent parent, then no payment may be made from the public 
  2.17  safety officer's benefit fund.  
  2.18     Subd. 2.  [ADJUSTMENT OF BENEFIT.] On October 1 of each 
  2.19  year beginning after the effective date of this subdivision, the 
  2.20  commissioner of public safety shall adjust the level of the 
  2.21  benefit payable immediately before October 1 under subdivision 
  2.22  1, to reflect the annual percentage change in the Consumer Price 
  2.23  Index for all urban consumers, published by the federal Bureau 
  2.24  of Labor Statistics, occurring in the one-year period ending on 
  2.25  June 1 immediately preceding such October 1.
