  1.1                          A bill for an act
  1.2             relating to local government; authorizing collection 
  1.3             of penalties and fines imposed by local governments 
  1.4             for certain violations of water and planning laws 
  1.5             together with taxes; amending Minnesota Statutes 1998, 
  1.6             section 394.37, by adding a subdivision; proposing 
  1.7             coding for new law in Minnesota Statutes, chapter 103F.
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [103F.002] [COLLECTION OF PENALTIES.] 
  1.10     If a penalty imposed for violation of an ordinance enacted 
  1.11  under this chapter is unpaid for more than 60 days after the 
  1.12  date when payment is due, the local government unit that imposed 
  1.13  the penalty may certify the delinquent penalty, together with 
  1.14  any interest and additional penalties that apply to it, to the 
  1.15  county auditor for collection to the same extent and in the same 
  1.16  manner provided by law for the assessment and collection of real 
  1.17  estate taxes. 
  1.18     Sec. 2.  Minnesota Statutes 1998, section 394.37, is 
  1.19  amended by adding a subdivision to read: 
  1.20     Subd. 5.  [COLLECTION OF PENALTIES.] If a fine or other 
  1.21  penalty imposed for violation of an ordinance, regulation, or 
  1.22  other official control adopted by the board under this chapter 
  1.23  is unpaid for more than 60 days after the date when payment is 
  1.24  due, the county board may certify the delinquent fine or 
  1.25  penalty, together with any interest and additional penalties 
  1.26  that apply to it, to the county auditor for collection to the 
  2.1   same extent and in the same manner provided by law for the 
  2.2   assessment and collection of real estate taxes.
