  1.1                          A bill for an act 
  1.2             relating to real property; clarifying requirements 
  1.3             relating to filing of notices relating to mechanics' 
  1.4             liens; amending Minnesota Statutes 1994, sections 
  1.5             514.08, subdivision 1; and 514.12, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 514.08, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [NOTICE REQUIRED.] The lien ceases at the 
  1.10  end of 120 days after doing the last of the work, or furnishing 
  1.11  the last item of skill, material, or machinery, unless within 
  1.12  this period: 
  1.13     (1) a statement of the claim is filed for record with the 
  1.14  county recorder or, if registered land, with the registrar of 
  1.15  titles of the county in which the improved premises are 
  1.16  situated, or, if the claim is made under section 514.04, with 
  1.17  the secretary of state; and 
  1.18     (2) a copy of the statement is served personally or by 
  1.19  certified mail on the owner or the owner's authorized agent or 
  1.20  the person who entered into the contract with the contractor. 
  1.21     Sec. 2.  Minnesota Statutes 1994, section 514.12, 
  1.22  subdivision 1, is amended to read: 
  1.23     Subdivision 1.  [RECORDING.] At the beginning of the action 
  1.24  the plaintiff shall file for record with the county recorder or, 
  1.25  if registered land, with the registrar of titles of the county 
  2.1   in which it is brought, and of the several counties if the lien 
  2.2   be claimed under section 514.04, a notice of the pendency 
  2.3   thereof, embracing therein a copy of the summons, omitting the 
  2.4   caption.
