  1.1                          A bill for an act 
  1.2             relating to education; authorizing school districts to 
  1.3             require students to wear uniforms; clarifying that 
  1.4             school officials may use reasonable force in certain 
  1.5             situations; amending Minnesota Statutes 1994, sections 
  1.6             120.73, by adding a subdivision; and 127.45, by adding 
  1.7             a subdivision; proposing coding for new law in 
  1.8             Minnesota Statutes, chapter 123. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1994, section 120.73, is 
  1.11  amended by adding a subdivision to read: 
  1.12     Subd. 2b.  [SCHOOL UNIFORMS.] Notwithstanding section 
  1.13  120.74, a school board may require students to furnish or 
  1.14  purchase clothing that constitutes a school uniform if the board 
  1.15  has adopted a uniform requirement under section 123.421. 
  1.16     Sec. 2.  [123.421] [SCHOOL UNIFORM REQUIREMENTS 
  1.17  AUTHORIZED.] 
  1.18     A school board may require students enrolled in any of its 
  1.19  schools to wear uniforms while in attendance at school during 
  1.20  the regular school day.  In establishing a uniform requirement, 
  1.21  a school board must adopt a school uniform policy that ensures 
  1.22  that students' constitutionally protected rights of freedom of 
  1.23  speech and religion are not infringed, promotes parent and 
  1.24  community involvement in the program, and accounts for the 
  1.25  ability of students to purchase uniforms. 
  1.26     Sec. 3.  Minnesota Statutes 1994, section 127.45, is 
  1.27  amended by adding a subdivision to read: 
  2.1      Subd. 2a.  [REASONABLE FORCE AUTHORIZED.] This section does 
  2.2   not prohibit teachers or other school employees from using 
  2.3   reasonable force as authorized in section 609.06 or elsewhere in 
  2.4   law. 
  2.5      Sec. 4.  [MODEL SCHOOL UNIFORM GUIDELINES.] 
  2.6      The department of education, in consultation with the 
  2.7   attorney general's office, shall develop model guidelines by 
  2.8   September 1, 1995, to assist school districts in developing 
  2.9   policies that require students to wear school uniforms under 
  2.10  Minnesota Statutes, section 123.421.  In developing the 
  2.11  guidelines, the department shall consider relevant state and 
  2.12  federal constitutional concerns such as freedom of speech and 
  2.13  religion, methods of promoting parent and community involvement, 
  2.14  and financial issues, including the ability of students to pay 
  2.15  for uniforms.  The guidelines are not subject to Minnesota 
  2.16  Statutes, chapter 14.
