  1.1                          A bill for an act
  1.2             relating to health; exempting dental services from the 
  1.3             regulated all-payer option and the MinnesotaCare 
  1.4             provider tax; amending Minnesota Statutes 1994, 
  1.5             section 295.50, subdivision 4; proposing coding for 
  1.6             new law in Minnesota Statutes, chapter 62P. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [62P.34] [EXEMPTION OF DENTAL SERVICES.] 
  1.9      Dental services shall not be subject to any fee schedule, 
  1.10  rate of increase control, or other reimbursement limit adopted 
  1.11  by the commissioner as part of the regulated all-payer option 
  1.12  established under this chapter. 
  1.13     Sec. 2.  Minnesota Statutes 1994, section 295.50, 
  1.14  subdivision 4, is amended to read: 
  1.15     Subd. 4.  [HEALTH CARE PROVIDER.] (a) "Health care 
  1.16  provider" means: 
  1.17     (1) a person furnishing any or all of the following goods 
  1.18  or services directly to a patient or consumer:  medical, 
  1.19  surgical, optical, visual, dental, hearing, nursing services, 
  1.20  drugs, medical supplies, medical appliances, laboratory, 
  1.21  diagnostic or therapeutic services, or any goods and services 
  1.22  not listed above that qualifies for reimbursement under the 
  1.23  medical assistance program provided under chapter 256B; 
  1.24     (2) a staff model health plan company; or 
  1.25     (3) a licensed ambulance service. 
  1.26     (b) Health care provider does not include hospitals, 
  2.1   nursing homes licensed under chapter 144A, pharmacies, and 
  2.2   surgical centers.  Health care provider does not include 
  2.3   dentists, dental hygienists, or registered dental assistants 
  2.4   licensed or registered under chapter 150A. 
  2.5      Sec. 3.  [FFECTIVE DATE.] 
  2.6      Sections 1 and 2 are effective the day following final 
  2.7   enactment.
