1.2relating to health; extending essential community provider designation;
1.3amending Minnesota Statutes 2006, section 62Q.19, subdivisions 2, 6.
1.4BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

1.5    Section 1. Minnesota Statutes 2006, section 62Q.19, subdivision 2, is amended to read:
1.6    Subd. 2. Application. (a) Any provider may apply to the commissioner for
1.7designation as an essential community provider by submitting an application form
1.8developed by the commissioner. Except as provided in paragraph (d), applications must be
1.9accepted within two years after the effective date of the rules adopted by the commissioner
1.10to implement this section.
1.11(b) Each application submitted must be accompanied by an application fee in an
1.12amount determined by the commissioner of $60. The fee shall be no more than what is
1.13needed to cover the administrative costs of processing the application.
1.14(c) The name, address, contact person, and the date by which the commissioner's
1.15decision is expected to be made shall be classified as public data under section 13.41. All
1.16other information contained in the application form shall be classified as private data
1.17under section 13.41 until the application has been approved, approved as modified, or
1.18denied by the commissioner. Once the decision has been made, all information shall be
1.19classified as public data unless the applicant designates and the commissioner determines
1.20that the information contains trade secret information.
1.21(d) The commissioner shall accept an application for designation as an essential
1.22community provider until June 30, 2004, from one applicant that is a nonprofit community
1.23services agency certified as a medical assistance provider that provides mental health,
1.24behavioral health, chemical dependency, employment, and health wellness services to
2.1the underserved Spanish-speaking Latino families and individuals with locations in
2.2Minneapolis and St. Paul.

2.3    Sec. 2. Minnesota Statutes 2006, section 62Q.19, subdivision 6, is amended to read:
2.4    Subd. 6. Termination or renewal of designation; commissioner review. The
2.5designation as an essential community provider shall be valid for a five-year period
2.6from the date of designation. Every five years after the designation or renewal of the
2.7designation of essential community provider is granted to a provider, the commissioner
2.8shall review the need for and appropriateness of continuing the designation for that
2.9provider. The commissioner may require a provider whose designation is to be reviewed
2.10to submit an application to the commissioner for renewal of the designation and may
2.11require an application fee of $60 to be submitted with the application to cover the
2.12administrative costs of processing the application. Based on that review, the commissioner
2.13may renew a provider's essential community provider designation for an additional
2.14five-year period or terminate the designation. Once the designation terminates, the former
2.15essential community provider has no rights or privileges beyond those of any other health
2.16care provider.
