A bill for an act
relating to broadband; requiring the Public Utilities Commission to establish
standards for broadband service; requiring a report to the commission; proposing
coding for new law in Minnesota Statutes, chapter 237.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

[237.013] BROADBAND SERVICE STANDARDS.

Subdivision 1.

Definition.

For the purposes of this section, "broadband service" has the
meaning given in section 116J.39, subdivision 1.

Subd. 2.

Standards.

By December 31, 2023, the commission must establish standards
for broadband service, including but not limited to standards governing reliability; resiliency;
quality; emergency preparedness; postemergency network restoration, including minimum
power-backup requirements; and equitability of deployment of broadband availability to
low-income areas and communities whose residents are predominantly from racial, ethnic,
cultural, or linguistic communities.

Subd. 3.

Report required.

Beginning December 31, 2024, and annually thereafter, each
broadband service provider must submit a written report to the commission, in a format
developed by the commission, that addresses the broadband service provider's:

(1) progress toward achieving the goals of section 237.012; and

(2) compliance with the standards established under subdivision 2.

EFFECTIVE DATE.

This section is effective the day following final enactment.
