A bill for an act
relating to greenhouse gas emissions; requiring estimates of consumption-based
greenhouse gas emissions; requiring a report; proposing coding for new law in
Minnesota Statutes, chapter 216H.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) "Commissioner" means the commissioner of the Pollution
Control Agency.

new text begin (b) "Consumption-based greenhouse gas emissions" means total lifecycle greenhouse
gas emissions emitted by anthropogenic sources associated with the production of goods
and services consumed in Minnesota.

new text begin (c) "Lifecycle greenhouse gas emissions" means carbon dioxide, methane, nitrous oxide,
hydrofluorocarbons, perfluorocarbons, and sulfur hexafluoride emissions, aggregated over
the complete lifecycle of the goods and services whose production generated the emissions,
including:

new text begin (1) raw materials extraction, transportation, and processing;
new text end

new text begin (2) transportation of inputs to production;
new text end

new text begin (3) production;
new text end

new text begin (4) wholesale and retail distribution of end products;
new text end

new text begin (5) use; and
new text end

new text begin (6) end-of-life activities.

new text begin Analysis; reporting. new text end

new text begin (a) The commissioner must develop a methodology to
estimate consumption-based greenhouse gas emissions. The commissioner must divide
statewide activities that generate consumption-based greenhouse gas emissions into
consumption categories, as determined by the commissioner, and must estimate emissions
separately for each consumption category and for each lifecycle stage listed in subdivision
1, paragraph (c).

new text begin (b) No later than January 15, 2025, and each January 15 every four years thereafter, the
commissioner must submit a written report to the chairs and ranking minority members of
the senate and house of representatives committees with primary jurisdiction over energy
policy and environmental policy detailing the findings of the analysis and comparing the
most recent data with data from earlier reports. The commissioner must post the report on
the Pollution Control Agency website. The initial report submitted under this subdivision
must contain recommendations regarding how the information can be used to formulate
policies and programs to reduce Minnesota's consumption-based greenhouse gas emissions.
