  1.1                          A bill for an act 
  1.2             relating to natural resources; restricting authority 
  1.3             to issue public waters work permits for floating 
  1.4             structures; amending Minnesota Statutes 1996, section 
  1.5             103G.245, subdivision 4. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 103G.245, 
  1.8   subdivision 4, is amended to read: 
  1.9      Subd. 4.  [STRUCTURES IN OR ADJACENT TO PUBLIC WATERS 
  1.10  OUTSIDE CITIES.] (a) The commissioner, subject to the approval 
  1.11  of the county board, may grant and prescribe terms and 
  1.12  conditions for granting public waters work permits to establish, 
  1.13  construct, maintain, and control wharves, docks, piers, levees, 
  1.14  breakwaters, basins, canals, and hangars in or adjacent to 
  1.15  public waters of the state, except within the corporate limits 
  1.16  of a municipality.  
  1.17     (b) Fixed floating structures having walls and a roof are 
  1.18  prohibited on public waters of Minnesota, except for houseboats 
  1.19  and as allowed by paragraph (c). 
  1.20     (c) The commissioner may issue a public waters work permit 
  1.21  for fixed floating structures having walls and a roof only: 
  1.22     (1) in areas of historic use for such structures, as 
  1.23  determined by the commissioner; 
  1.24     (2) when approved by the local government unit; and 
  1.25     (3) where the structure is in existence on public waters 
  2.1   prior to January 1, 1997.
