A bill for an act
relating to police officers; permitting police officers to be represented by an
attorney and a union representative at disciplinary hearing; amending Minnesota
Statutes 2006, section 626.89, subdivision 9.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2006, section 626.89, subdivision 9, is amended to read:
The officer whose
formal statement is taken has the right to have an attorney deleted text begin ordeleted text end new text begin and anew text end union representative of
the officer's choosing present during the session. The officer may request the presence
of an attorney deleted text begin ordeleted text end new text begin and anew text end union representative at any time before or during the session.
When a request under this subdivision is made, no formal statement may be taken until a
reasonable opportunity is provided for the officer to obtain the presence of the attorney
deleted text begin ordeleted text end new text begin and thenew text end union representative.

Section 1 is effective the day following final enactment.
