A bill for an act
relating to employment; providing for the minimum age for safe amusement ride
operation; amending Minnesota Statutes 2018, sections 181A.04, subdivision 5;
184B.021.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2018, section 181A.04, subdivision 5, is amended to read:
new text begin (a) new text end No minor under the age of 18 shall be permitted
to work in any occupation which the commissioner shall find to be particularly hazardous
for the employment of children under 18 years of age or detrimental to their well-being. A
list of such occupations shall be established and promulgated by rule pursuant to section
181A.09.
new text begin (b)new text end Notwithstanding any law or rule to the contrary, this subdivision does not apply tonew text begin
the following:

new text begin (1)new text end minors employed in retail stores that are nonseasonal and are of a nontransient nature
and which sell or offer for sale explosives or pyrotechnicsnew text begin ; or

new text begin (2) minors, at least 16 years of age, employed in an amusement park in the loading or
unloading of passengers on rides or in the operation of amusement rides, as defined in
section 184B.01new text end .
Minnesota Statutes 2018, section 184B.021, is amended to read:

Ride operators must be at least 16
years of age.

The owner of an amusement ride must have a
documented training policy for the operation of an amusement ride. The ride owner must
maintain a written certification for each person controlling the physical operation of an
amusement ride that the person has received the training for the ride that is required by the
documented training policy.
