  1.1                          A bill for an act
  1.2             relating to the state building code; providing for 
  1.3             certain energy code rules to remain in effect. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [ENERGY CODE RULES REMAIN IN EFFECT.] 
  1.6      (a) Notwithstanding Laws 1999, chapter 135, section 9, 
  1.7   Minnesota Rules, chapter 7670, does not expire on April 15, 
  1.8   2000, but remains in effect for residential buildings not 
  1.9   covered by Minnesota Rules, chapter 7676.  The provisions of 
  1.10  Minnesota Rules, chapter 7670, that apply to category 1 
  1.11  buildings govern new, detached single one- and two-family R-3 
  1.12  occupancy residential buildings.  All new, detached single one- 
  1.13  and two-family R-3 occupancy buildings subject to Minnesota 
  1.14  Rules, chapter 7670, submitting an application for a building 
  1.15  permit after April 14, 2000, must meet the requirements for 
  1.16  category 1 buildings, as set out in Minnesota Rules, chapter 
  1.17  7670.  All new, detached single one- and two-family R-3 
  1.18  occupancy buildings must include a heat recovery or balanced 
  1.19  ventilation system.  All new detached single one- and two-family 
  1.20  R-3 occupancy buildings having fuel-burning equipment using 
  1.21  nonsolid fuels for space heating, service water heating, or 
  1.22  hearth products must install direct vent, power vent, or sealed 
  1.23  combustion equipment.  If any single exhaust device over 300 
  1.24  cubic feet per minute is installed, sealed combustion space 
  2.1   heating equipment must be used. 
  2.2      (b) As an alternative to compliance with paragraph (a), 
  2.3   compliance with Minnesota Rules, chapters 7672 and 7674, is 
  2.4   optional for a contractor or owner until July 1, 2002.  
  2.5   Minnesota Rules, chapter 7670, remains in effect until July 1, 
  2.6   2002. 
  2.7      (c) The department of administration, buildings codes and 
  2.8   standards division (BCSD), shall issue a report to the 
  2.9   legislature by December 1, 2001, addressing the cost benefit, as 
  2.10  well as air quality, building durability, moisture, enforcement, 
  2.11  enforceability, and liability regarding implementation of 
  2.12  Minnesota Rules, chapters 7670, 7672, and 7674. 
  2.13     Sec. 2.  [EFFECTIVE DATE.] 
  2.14     Section 1 is effective the day following final enactment.
