A bill for an act
relating to consumer protection; providing for the termination of a wireless
services contract without penalty upon the death of a customer; proposing coding
for new law in Minnesota Statutes, chapter 325F.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

[325F.697] TERMINATION OF WIRELESS SERVICES CONTRACT
UPON DEATH.

Subdivision 1.

Definitions.

(a) The definitions in this subdivision apply to this
section.

(b) "Contract" means an oral or written agreement of definite duration between
a provider and a customer, detailing the wireless telecommunications services to be
provided to the customer and the terms and conditions for provision of those services.

(c) "Wireless telecommunications services" means commercial mobile radio services
as defined in Code of Federal Regulations, title 47, part 20.

(d) "Provider" means a provider of wireless telecommunications services.

Subd. 2.

Contract termination at customer's death.

A contract is terminated three
business days after receipt by the provider, via certified mail, of a certified death certificate
in the name of the customer receiving services under the contract. A provider may not
charge a fee for terminating a contract under this section.

EFFECTIVE DATE.

This section is effective the day following final enactment.
