  1.1                          A bill for an act 
  1.2             relating to health; including medium chain acyl-CoA 
  1.3             dehydrogenase deficiency in the testing and follow-up 
  1.4             program for inborn metabolic defects in infants; 
  1.5             directing the commissioner of health to amend rules; 
  1.6             appropriating money; amending Minnesota Statutes 1998, 
  1.7             sections 144.126; and 144.128. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 144.126, is 
  1.10  amended to read: 
  1.11     144.126 [INBORN METABOLISM ERROR TESTING PROGRAMS.] 
  1.12     The commissioner shall provide on a statewide basis without 
  1.13  charge to the recipient, treatment control tests for which 
  1.14  approved laboratory procedures are available for 
  1.15  hemoglobinopathy, phenylketonuria, medium chain acyl-CoA 
  1.16  dehydrogenase deficiency, and other inborn errors of metabolism. 
  1.17     Sec. 2.  Minnesota Statutes 1998, section 144.128, is 
  1.18  amended to read: 
  1.19     144.128 [TREATMENT FOR POSITIVE DIAGNOSIS, REGISTRY OF 
  1.20  CASES.] 
  1.21     The commissioner shall: 
  1.22     (1) make arrangements for the necessary treatment of 
  1.23  diagnosed cases of hemoglobinopathy, phenylketonuria, medium 
  1.24  chain acyl-CoA dehydrogenase deficiency, and other inborn errors 
  1.25  of metabolism when treatment is indicated and the family is 
  1.26  uninsured and, because of a lack of available income, is unable 
  2.1   to pay the cost of the treatment; 
  2.2      (2) maintain a registry of cases of hemoglobinopathy, 
  2.3   phenylketonuria, medium chain acyl-CoA dehydrogenase deficiency, 
  2.4   and other inborn errors of metabolism for the purpose of 
  2.5   follow-up services; and 
  2.6      (3) adopt rules to carry out section 144.126 and this 
  2.7   section. 
  2.8      Sec. 3.  [AMENDMENTS TO RULES ON TESTING INFANTS FOR INBORN 
  2.9   METABOLIC DEFECTS.] 
  2.10     The commissioner of health shall amend Minnesota Rules, 
  2.11  parts 4615.0300 to 4615.0760, to include medium chain acyl-CoA 
  2.12  dehydrogenase deficiency in the testing and follow-up program 
  2.13  for inborn metabolic defects in infants.  The amendments 
  2.14  required by this section must be done in the manner specified in 
  2.15  Minnesota Statutes, section 14.388, under the authority of 
  2.16  clause (3) of that section.  Minnesota Statutes, section 14.386, 
  2.17  paragraph (b), does not apply to amendments to rules adopted 
  2.18  under this section. 
  2.19     Sec. 4.  [APPROPRIATION.] 
  2.20     $....... in fiscal year 2001 is appropriated from the state 
  2.21  government special revenue fund to the commissioner of health to 
  2.22  fund testing and follow-up for medium chain acyl-CoA 
  2.23  dehydrogenase deficiency in the testing and follow-up program 
  2.24  for inborn metabolic defects in infants, in Minnesota Statutes, 
  2.25  sections 144.125 to 144.128.
