  1.1                          A bill for an act
  1.2             relating to health; providing for health coverage for 
  1.3             Minnesota children with special health needs; 
  1.4             appropriating money; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 145. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [145.8905] [CHILDREN WITH SPECIAL HEALTH 
  1.8   NEEDS.] 
  1.9      Subdivision 1.  [HEALTH COVERAGE.] When cost-effective, the 
  1.10  commissioner may use money received for the services for 
  1.11  children with special health needs program to purchase health 
  1.12  coverage for eligible children. 
  1.13     Subd. 2.  [CO-PAYMENT.] Each family participating in the 
  1.14  children with special health needs program is charged a $50 per 
  1.15  month co-payment.  The revenue raised by the co-payment must be 
  1.16  deposited in the children with special health needs account in 
  1.17  the special revenue fund.  The revenue raised by the co-payments 
  1.18  is intended to maximize potential federal matching funds. 
  1.19     [EFFECTIVE DATE.] This section is effective July 1, 2004. 
  1.20     Sec. 2.  [DIRECTION TO COMMISSIONER.] 
  1.21     Effective July 1, 2004, the commissioner of health is 
  1.22  directed to reinstate rules related to the children with special 
  1.23  health needs program as the rules appeared on June 30, 2003. 
  1.24     Sec. 3.  [APPROPRIATION.] 
  1.25     Amounts deposited in the children with special health needs 
  2.1   account in the special revenue fund in fiscal year 2005 are 
  2.2   appropriated to the commissioner of health for the children with 
  2.3   special health needs program.
