  1.1                          A bill for an act 
  1.2             relating to human services; modifying language for 
  1.3             adoption assistance purchase of service reimbursement; 
  1.4             amending Minnesota Statutes 1996, section 259.67, 
  1.5             subdivision 7. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 259.67, 
  1.8   subdivision 7, is amended to read: 
  1.9      Subd. 7.  [REIMBURSEMENT OF COSTS.] Notwithstanding the 
  1.10  provisions of subdivision 10 and subject to rules of the 
  1.11  commissioner, and the provisions of this subdivision a 
  1.12  Minnesota-licensed child-placing agency or county social service 
  1.13  agency shall receive a reimbursement from the commissioner equal 
  1.14  to 100 percent of the reasonable and appropriate cost of 
  1.15  providing adoption services for a child certified as eligible 
  1.16  for adoption assistance.  Such assistance may include adoptive 
  1.17  family recruitment, counseling, and special training when 
  1.18  needed.  A Minnesota-licensed child-placing agency shall receive 
  1.19  reimbursement for adoption services it purchases for or directly 
  1.20  provides to an eligible child.  A county social service agency 
  1.21  shall receive such reimbursement only for adoption services it 
  1.22  purchases for an eligible child. 
  1.23     A Minnesota-licensed child-placing agency or county social 
  1.24  service agency seeking reimbursement under this subdivision 
  1.25  shall enter into a reimbursement agreement with the commissioner 
  2.1   before providing adoption services for which reimbursement is 
  2.2   sought.  No reimbursement under this subdivision shall be made 
  2.3   to an agency for services provided prior to entering a 
  2.4   reimbursement agreement.  Separate reimbursement agreements 
  2.5   shall be made for each child and separate records shall be kept 
  2.6   on each child for whom a reimbursement agreement is made.  Funds 
  2.7   encumbered and obligated under such an agreement for the child 
  2.8   remain available until the terms of the agreement are fulfilled 
  2.9   or the agreement is terminated.
