1.1 A bill for an act 1.2 relating to crime; creating the felony of gambling 1.3 fraud; providing penalties; proposing coding for new 1.4 law in Minnesota Statutes, chapter 609. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [609.763] [LAWFUL GAMBLING FRAUD.] 1.7 Subdivision 1. [FELONY.] A person is guilty of a felony 1.8 and may be sentenced under subdivision 2 if the person does any 1.9 of the following: 1.10 (1) knowingly claims or attempts to claim a lawful gambling 1.11 prize using altered or counterfeited gambling equipment; 1.12 (2) knowingly claims or attempts to claim a lawful gambling 1.13 prize by means of fraud, deceit, or misrepresentation; 1.14 (3) manipulates any form of lawful gambling or tampers with 1.15 any gambling equipment with intent to influence the outcome of a 1.16 game or the receipt of a prize; or 1.17 (4) knowingly places false information on a prize receipt 1.18 or any other form used to record prizes or identify winners. 1.19 Subd. 2. [PENALTY.] A person who violates subdivision 1 1.20 may be sentenced to imprisonment for not more than ten years or 1.21 to payment of a fine of not more than $50,000, or both.
