  1.1                          A bill for an act 
  1.2             relating to utilities; making energy reliability 
  1.3             utility assessments retroactive; amending Minnesota 
  1.4             Statutes 2003 Supplement, section 216C.052, 
  1.5             subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2003 Supplement, section 
  1.8   216C.052, subdivision 3, is amended to read: 
  1.9      Subd. 3.  [ASSESSMENT AND APPROPRIATION.] In addition to 
  1.10  the amount noted in subdivision 2, the commissioner may assess 
  1.11  utilities, using the mechanism specified in that subdivision, up 
  1.12  to an additional $500,000 annually through June 30, 2006.  The 
  1.13  amounts assessed under this subdivision are appropriated to the 
  1.14  commissioner, and some or all of the amounts assessed may be 
  1.15  transferred to the commissioner of administration, for the 
  1.16  purposes specified in section 16B.325 and Laws 2001, chapter 
  1.17  212, article 1, section 3, as needed to implement those sections.
  1.18     This subdivision is effective retroactively from July 1, 
  1.19  2001. 
  1.20     [EFFECTIVE DATE.] This section is effective the day 
  1.21  following final enactment.
