  1.1                          A bill for an act 
  1.2             relating to motor vehicles; authorizing sale of 
  1.3             unauthorized, impounded vehicles within 15 days of 
  1.4             notice unless owner declares intent to reclaim; 
  1.5             amending Minnesota Statutes 2000, sections 168B.051, 
  1.6             subdivision 1a; 168B.07, subdivision 1; repealing 
  1.7             Minnesota Statutes 2000, sections 168B.051, 
  1.8             subdivision 2; 168B.06, subdivision 3. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 168B.051, 
  1.11  subdivision 1a, is amended to read: 
  1.12     Subd. 1a.  [SALE 15 DAYS AFTER NOTICE BY CERTIFIED MAIL.] 
  1.13  (a) Except as provided in paragraph (b), an unauthorized vehicle 
  1.14  impounded by the city of Minneapolis or by the city of St. Paul 
  1.15  is eligible for disposal or sale under section 168B.08, 15 days 
  1.16  after notice is sent by certified mail, return receipt 
  1.17  requested, to the registered owner, if any, of the unauthorized 
  1.18  vehicle and to all readily identifiable lienholders of record.  
  1.19     (b) If, before the expiration of the 15-day period 
  1.20  following notice of taking, the registered owner or lienholder 
  1.21  of record delivers to the impound lot operator a written 
  1.22  statement of intent to reclaim the vehicle, the vehicle is not 
  1.23  eligible for disposal or sale until 45 days after the notice of 
  1.24  taking, if the owner or lienholder has not reclaimed under 
  1.25  section 168B.07.  Notwithstanding section 168B.06, subdivision 
  1.26  3, a second notice shall not be required. 
  1.27     Sec. 2.  Minnesota Statutes 2000, section 168B.07, 
  2.1   subdivision 1, is amended to read: 
  2.2      Subdivision 1.  [PAYMENT OF CHARGES.] The owner or any 
  2.3   lienholder of an impounded vehicle shall have a right to reclaim 
  2.4   such vehicle from the unit of government or impound lot operator 
  2.5   taking it into custody upon payment of all towing and storage 
  2.6   charges resulting from taking the vehicle into custody within 15 
  2.7   or 45 days, as applicable under section 168B.051, subdivision 1, 
  2.8   or 1a, or 2, after the date of the notice required by section 
  2.9   168B.06. 
  2.10     Sec. 3.  [REPEALER.] 
  2.11     Minnesota Statutes 2000, sections 168B.051, subdivision 2; 
  2.12  and 168B.06, subdivision 3, are repealed.
