  1.1                          A bill for an act
  1.2             relating to education; changing candidate advisory 
  1.3             council membership; changing council on vocational 
  1.4             technical education membership; amending Minnesota 
  1.5             Statutes 1994, section 137.0245, subdivision 2; and 
  1.6             Minnesota Statutes 1995 Supplement, sections 136F.03, 
  1.7             subdivision 2; and 136F.56, subdivisions 1, 2, 6, 7, 
  1.8             and by adding a subdivision. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1995 Supplement, section 
  1.11  136F.03, subdivision 2, is amended to read: 
  1.12     Subd. 2.  [MEMBERSHIP.] The advisory council consists of 24 
  1.13  14 members.  Twelve Five members are appointed by the 
  1.14  subcommittee on committees of the committee on rules and 
  1.15  administration of the senate.  Twelve, five members are 
  1.16  appointed by the speaker of the house of representatives.  Four 
  1.17  members are appointed by the governor.  No more than one-third 
  1.18  two of the members appointed by each appointing authority may be 
  1.19  current or former legislators.  No more than two-thirds four of 
  1.20  the members appointed by each appointing authority may belong to 
  1.21  the same political party; however, political activity or 
  1.22  affiliation is not required for the appointment of a member.  
  1.23  Geographical representation must be taken into consideration 
  1.24  when making appointments.  Section 15.0575 governs the advisory 
  1.25  council, except that the members must be appointed to six-year 
  1.26  terms.  
  1.27     Sec. 2.  Minnesota Statutes 1995 Supplement, section 
  2.1   136F.56, subdivision 1, is amended to read: 
  2.2      Subdivision 1.  [STATE AGENCY PURPOSE AND DUTIES.] The 
  2.3   state council on vocational technical education, formerly known 
  2.4   as the Minnesota state advisory council for vocational 
  2.5   education, is a state agency in the executive branch.  Its 
  2.6   purpose is to implement section 112 of the Carl D. Perkins 
  2.7   Vocational Education Act of 1984, United States Code, title 20, 
  2.8   section 2322, and other purposes necessary to improve and 
  2.9   promote vocational technical education. 
  2.10     Sec. 3.  Minnesota Statutes 1995 Supplement, section 
  2.11  136F.56, subdivision 2, is amended to read: 
  2.12     Subd. 2.  [MEMBERS; TERMS.] The governor shall appoint the 
  2.13  members of the council according to United States Code, title 
  2.14  20, section 2322.  Except as otherwise provided by that act, 
  2.15  Members are governed by section 15.0575.  The council consists 
  2.16  of 16 members appointed to four-year terms.  The members must be 
  2.17  people who have an interest or expertise in vocational technical 
  2.18  education.  One-half of the members shall be from the private 
  2.19  sector.  Geographical diversity must be taken into consideration 
  2.20  by the governor in making appointments. 
  2.21     Sec. 4.  Minnesota Statutes 1995 Supplement, section 
  2.22  136F.56, is amended by adding a subdivision to read: 
  2.23     Subd. 2a.  [COUNCIL OPERATION.] The council shall establish 
  2.24  its rules of operation, which must include provisions for public 
  2.25  input. 
  2.26     Sec. 5.  Minnesota Statutes 1995 Supplement, section 
  2.27  136F.56, subdivision 6, is amended to read: 
  2.28     Subd. 6.  [FISCAL AGENT.] The board Minnesota state 
  2.29  colleges and universities shall act as fiscal agent for the 
  2.30  council and provide other support services necessary for 
  2.31  disbursements, accounting, auditing, and reporting. 
  2.32     Sec. 6.  Minnesota Statutes 1995 Supplement, section 
  2.33  136F.56, subdivision 7, is amended to read: 
  2.34     Subd. 7.  [STAFF.] The council may employ an executive 
  2.35  director and other staff needed to carry out its duties.  The 
  2.36  council may determine its staff needs and select its staff.  The 
  3.1   executive director shall serve serves in the unclassified 
  3.2   service and may be paid an allowance not to exceed $2,000 
  3.3   annually for miscellaneous expenses in connection with duties of 
  3.4   the office. The council may contract with professional, 
  3.5   technical, and clerical consultants and interns needed to carry 
  3.6   out its functions. 
  3.7      Sec. 7.  Minnesota Statutes 1994, section 137.0245, 
  3.8   subdivision 2, is amended to read: 
  3.9      Subd. 2.  [MEMBERSHIP.] The regent candidate advisory 
  3.10  council shall consist of 24 14 members.  Twelve Seven members 
  3.11  shall be appointed by the subcommittee on committees of the 
  3.12  committee on rules and administration of the senate.  Twelve, 
  3.13  seven members shall be appointed by the speaker of the house of 
  3.14  representatives.  No more than one-third two of the members 
  3.15  appointed by each appointing authority may be current or former 
  3.16  legislators.  No more than two-thirds four of the members 
  3.17  appointed by each appointing authority may belong to the same 
  3.18  political party; however, political activity or affiliation is 
  3.19  not required for the appointment of any member.  Geographical 
  3.20  representation must be taken into consideration when making 
  3.21  appointments.  Section 15.0575 shall govern the advisory 
  3.22  council, except that the members shall be appointed to six-year 
  3.23  terms with one-third appointed each even-numbered year. 
  3.24     Sec. 8.  [TRANSITION OF COUNCIL MEMBERS.] 
  3.25     (a) Terms of all current members of the regent candidate 
  3.26  advisory council and the Minnesota state college and university 
  3.27  candidate advisory council are terminated on June 30, 1996.  By 
  3.28  July 1, 1996, the speaker of the house and the subcommittee on 
  3.29  committees of the committee on rules and administration of the 
  3.30  senate shall make their appointments to the regent candidate 
  3.31  advisory council.  These appointments may include current 
  3.32  council members.  The speaker of the house and the subcommittee 
  3.33  on committees of the committee on rules and administration of 
  3.34  the senate shall each appoint four members to four-year initial 
  3.35  terms and three members to two-year initial terms.  By July 1, 
  3.36  1996, the speaker of the house, the subcommittee on committees 
  4.1   of the committee on rules and administration of the senate, and 
  4.2   the governor shall make their appointments to the Minnesota 
  4.3   state college and university candidate advisory council.  These 
  4.4   appointments may include current council members.  The speaker 
  4.5   of the house and the subcommittee on committees of the committee 
  4.6   on rules and administration of the senate shall each appoint 
  4.7   three members to four-year initial terms and two members to 
  4.8   two-year initial terms.  The governor shall appoint two members 
  4.9   to four-year initial terms and two members to two-year initial 
  4.10  terms. 
  4.11     (b) Terms of all current members of the state council on 
  4.12  vocational technical education are terminated on June 30, 1996.  
  4.13  By July 1, 1996, the governor shall make appointments to the 
  4.14  council.  These appointments may include current council 
  4.15  members.  The governor shall appoint eight members to four-year 
  4.16  initial terms and eight members to two-year initial terms. 
  4.17     Sec. 9.  [EFFECTIVE DATE.] 
  4.18     Sections 1 to 8 are effective the day following final 
  4.19  enactment.
