A bill for an act
relating to local government; authorizing Stearns,
Benton, and Sherburne County Boards to initiate a
process for the change of county boundaries by
resolution.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin STEARNS, BENTON COUNTIES; RESOLUTION TO BEGIN
PROCESS FOR CHANGE OF BOUNDARIES.

new text begin The county boards for the counties of Stearns and Benton
may initiate the process to change the boundary between the two
counties to include within Stearns County that portion of the
city of St. Cloud that is currently in Benton County if each
county board adopts a resolution in support of the change. The
resolutions may also propose to include within Stearns County
the entire territory of any township in Benton County that abuts
any part of the city of St. Cloud. The resolution is in lieu of
the petition required under Minnesota Statutes, section 370.02.
The process for the change of county boundaries must otherwise
comply with Minnesota Statutes, sections 370.01 to 370.24.

approval in accordance with Minnesota Statutes, section 645.023,
subdivision 1, clause (a), on the day following final
enactment. This section expires January 1, 2007.

resolutions may also propose to include within Stearns County
the entire territory of Haven Township in Sherburne County. The
resolution is in lieu of the petition required under Minnesota
Statutes, section 370.02. The process for the change of county
boundaries must otherwise comply with Minnesota Statutes,
sections 370.01 to 370.24.
