  1.1                          A bill for an act
  1.2             relating to commerce; prohibiting licensed collectors 
  1.3             from using assumed names; amending Minnesota Statutes 
  1.4             1997 Supplement, section 332.33, subdivision 1. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.7   332.33, subdivision 1, is amended to read: 
  1.8      Subdivision 1.  [REQUIREMENT.] Except as otherwise provided 
  1.9   in this chapter, no person shall conduct within this state a 
  1.10  collection agency or engage within this state in the business of 
  1.11  collecting claims for others as defined in sections 332.31 to 
  1.12  332.45, without having first applied for and obtained a 
  1.13  collection agency license.  A person acting under the authority 
  1.14  of a collection agency, as a collector, must first obtain a 
  1.15  Minnesota collector license.  A licensed collector may use one 
  1.16  additional assumed name only if the assumed name is registered 
  1.17  with and approved by the commissioner.  A person holding a 
  1.18  Minnesota collector license may not use an assumed name.
