  1.1                          A bill for an act 
  1.2             relating to health; clarifying the definition of the 
  1.3             practice of psychology; amending Minnesota Statutes 
  1.4             2002, section 148.89, subdivision 5. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 148.89, 
  1.7   subdivision 5, is amended to read: 
  1.8      Subd. 5.  [PRACTICE OF PSYCHOLOGY.] "Practice of 
  1.9   psychology" means the observation, description, evaluation, 
  1.10  interpretation, and or modification of human behavior by the 
  1.11  application of psychological principles, methods, and or 
  1.12  procedures, to prevent or, eliminate, or manage symptomatic, 
  1.13  maladaptive, or undesired behavior and to enhance interpersonal 
  1.14  relationships, work and, life and developmental adjustment, 
  1.15  personal and organizational effectiveness, behavioral health, 
  1.16  and mental health.  The practice of psychology includes, but is 
  1.17  not limited to, the following services, regardless of whether 
  1.18  the provider receives payment for the services: 
  1.19     (1) psychological research, psychological testing, and 
  1.20  teaching of psychology, and the evaluation or assessment of 
  1.21  personal characteristics such as intelligence, personality, 
  1.22  abilities, interests, aptitudes, and neuropsychological 
  1.23  functioning; 
  1.24     (2) assessment, including psychological testing and other 
  1.25  means of evaluating personal characteristics such as 
  2.1   intelligence, personality, abilities, interests, aptitudes, and 
  2.2   neuropsychological functioning; 
  2.3      (3) a psychological report, whether written or oral, 
  2.4   including testimony of a provider as an expert witness, 
  2.5   concerning the characteristics of an individual or entity; 
  2.6      (4) psychotherapy, including but not limited to, categories 
  2.7   such as behavioral, cognitive, emotive, systems, 
  2.8   psychophysiological, or insight-oriented therapies, counseling, 
  2.9   psychoanalysis, psychotherapy, hypnosis, biofeedback, and 
  2.10  diagnosis and treatment of:  
  2.11     (i) mental and emotional disorder or disability; 
  2.12     (ii) alcoholism alcohol and substance dependence or abuse; 
  2.13     (iii) disorders of habit or conduct; 
  2.14     (iv) the psychological aspects of physical illness or 
  2.15  condition, accident, injury, or disability; 
  2.16     (v) life adjustment issues, including work-related and 
  2.17  bereavement issues; and 
  2.18     (vi) child, family, or relationship issues; and 
  2.19     (vii) work-related issues; and 
  2.20     (3) (5) psychoeducational evaluation, therapy, remediation, 
  2.21  consultation, and supervision services and treatment; and 
  2.22     (6) consultation and supervision.
