  1.1                          A bill for an act 
  1.2             relating to natural resources; modifying provisions 
  1.3             for all-terrain vehicle use on certain wildlife 
  1.4             management area lands; adding to state wildlife 
  1.5             management areas; providing for certain land 
  1.6             exchanges; permitting the sale of certain consolidated 
  1.7             conservation land in Roseau county; amending Minnesota 
  1.8             Statutes 2000, section 97A.133, subdivision 3. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2000, section 97A.133, 
  1.11  subdivision 3, is amended to read: 
  1.12     Subd. 3.  [ALL-TERRAIN VEHICLE TRAVEL WITHIN DESIGNATED 
  1.13  WILDLIFE MANAGEMENT AREAS.] (a) On lands acquired by the state 
  1.14  under chapter 84A that are designated after January 1, 1986, as 
  1.15  wildlife management areas, the commissioner shall, by January 
  1.16  15, 2003 2004, identify and designate corridor trails in 
  1.17  corridors of disturbance that the commissioner determines are 
  1.18  appropriate to connect trails, forest roads established under 
  1.19  section 89.71, subdivision 1, and public highways to provide 
  1.20  reasonable travel for all-terrain vehicles.  The commissioner 
  1.21  shall consult with wildlife management area users, including 
  1.22  both motorized and nonmotorized trail users, in identifying and 
  1.23  designating corridor trails under this paragraph.  Corridor 
  1.24  trail establishment must be in compliance with other state and 
  1.25  federal law.  Local governments and other trail sponsors may 
  1.26  propose the designation of corridor trails, including the 
  1.27  designation as a grant-in-aid trail for the purposes of funding 
  2.1   under section 84.927, subdivision 2. 
  2.2      (b) The following forest roads shall be open to travel by 
  2.3   all-terrain vehicles when the roads are open to other 
  2.4   noncommercial vehicles: 
  2.5      (1) the Rapid River forest road, beginning at the west 
  2.6   boundary of the Red Lake wildlife management area at the 
  2.7   southwest corner of Section 7, Township 156 North, Range 35 
  2.8   West, Beltrami county, thence in an easterly and northeasterly 
  2.9   direction through the Red Lake wildlife management area to the 
  2.10  east boundary of the Red Lake wildlife management area at the 
  2.11  southwest corner of Section 7, Township 157 North, Range 33 
  2.12  West, Lake of the Woods county; 
  2.13     (2) the Blanchard forest road, beginning at the junction of 
  2.14  the North Shore Road along the northern shore of Upper Red Lake 
  2.15  and the Blanchard state forest road at the west section line of 
  2.16  Section 30, Township 155 North, Range 31 West, Beltrami county, 
  2.17  thence in a westerly direction to the west section line of 
  2.18  Section 31, Township 155 North, Range 32 West; and 
  2.19     (3) the Moose River forest road, beginning at the junction 
  2.20  of Dick's Parkway state forest road and the Moose River state 
  2.21  forest road at the southwest corner of Section 31, Township 36 
  2.22  West, Range 158 North, thence in a westerly direction along the 
  2.23  Moose River state forest road to the junction of Beltrami county 
  2.24  road 706. 
  2.25     (c) The commissioner shall seek the advice of a working 
  2.26  group for each affected county to identify and designate 
  2.27  corridor trails under paragraph (a).  The working group shall 
  2.28  consist of a county board representative, chosen by the county 
  2.29  board, a staff member of the department of natural resources who 
  2.30  is assigned to the region, a representative of local all-terrain 
  2.31  vehicle users chosen by the county board, and a representative 
  2.32  of nonmotorized wildlife management area users chosen by the 
  2.33  commissioner.  The working group may consider other access 
  2.34  issues and forward recommendations to the commissioner.  Each 
  2.35  working group must meet at least once by October 1, 2001, and 
  2.36  shall meet as necessary after that date. 
  3.1      (d) The commissioner shall sign each road and trail 
  3.2   designated under this subdivision indicating the motorized uses 
  3.3   allowed. 
  3.4      (e) During the regular firearms deer season, on all 
  3.5   wildlife management area lands within the area described in 
  3.6   paragraph (f), a person licensed to take deer may operate an 
  3.7   all-terrain vehicle: 
  3.8      (1) before legal shooting hours; 
  3.9      (2) after legal shooting hours; and 
  3.10     (3) from 11:00 a.m. to 2:00 p.m. 
  3.11     (f) Paragraph (e) applies from where state highway No. 1 
  3.12  intersects the west boundary of the Red Lake Indian Reservation, 
  3.13  then West to state highway No. 219, then North on state highway 
  3.14  No. 219 to state highway No. 89, then North on state highway No. 
  3.15  89 to county highway No. 6, then East on county highway No. 6 to 
  3.16  county highway No. 54 and county highway No. 1 
  3.17  (Beltrami/Marshall county line) then North along the 
  3.18  Beltrami/Marshall county line to Roseau county line, then East 
  3.19  on Beltrami/Roseau county line to Dick's Parkway, then South on 
  3.20  Dick's Parkway to county road No. 704, Beltrami county, then 
  3.21  South to county state-aid highway No. 44 to Fourtown, then South 
  3.22  on state highway No. 89 to the North boundary of the Red Lake 
  3.23  Indian Reservation, then West and South following the boundary 
  3.24  of the Red Lake Indian Reservation to where it intersects state 
  3.25  highway No. 1. 
  3.26     (g) By January 15, in 2002, 2003, and 2004, the 
  3.27  commissioner shall provide a report to senate and house policy 
  3.28  and finance committees with jurisdiction over natural resources 
  3.29  on the progress in identifying and designating corridor trails 
  3.30  under this subdivision and other access issues.  The report 
  3.31  shall include a status report for each county with updates of 
  3.32  the activities of the working groups established in paragraph 
  3.33  (c). 
  3.34     (d) (h) For the purposes of this subdivision, "corridors of 
  3.35  disturbance" means rights-of-way such as ditches, ditch banks, 
  3.36  transmission lines, pipelines, permanent roads, winter roads, 
  4.1   and recreational trails.  The existence of a corridor of 
  4.2   disturbance eligible for corridor designation may be 
  4.3   demonstrated by physical evidence, document recorded in the 
  4.4   office of the county recorder or other public official, aerial 
  4.5   survey, or other evidence similar to the above.  Cross-country 
  4.6   motorized use of land shall not cause that land to be considered 
  4.7   a corridor of disturbance.

 15.32     (a) Notwithstanding the classification and public sale 
 15.33  provisions of Minnesota Statutes, chapters 84A and 282, or other 
 15.34  law to the contrary, Roseau county may sell, either by public 
 15.35  sale or private sale, the consolidated conservation land that is 
 15.36  described in paragraph (d) under the remaining provisions of 
 16.1   Minnesota Statutes, chapters 84A and 282. 
 16.2      (b) The land described in paragraph (d) may be sold without 
 16.3   the public hearing required under Minnesota Statutes, section

 16.6      (c) The conveyance must be in a form approved by the 
 16.7   attorney general and for not less than the appraised value of

 16.24  a written warning, and directed to leave, or escorted out, of 
 16.25  the wildlife management area, if this is the person's first 
 16.26  offense; 
 16.27     (3) a person who has received prior warnings, either 
 16.28  written or verbal, from an enforcement officer, directly 
 16.29  relating to all-terrain vehicle operation in wildlife management 
 16.30  areas, and who is observed illegally operating an all-terrain 
 16.31  vehicle in the wildlife management area may be issued a 
 16.32  citation; and 
 16.33     (4) a person who is operating an all-terrain vehicle in a 
 16.34  wildlife management area and who is intentionally creating 
 16.35  serious damage to the wildlife management area, or who is 
 16.36  involved in some other violations of law, will be issued 
 17.1   appropriate citations or arrested. 
 17.2      Sec. 6.  [EFFECTIVE DATE.] 
 17.3      Section 2 is effective the day following final enactment 
 17.4   and for the purposes of the payments in lieu of taxes under 
 17.5   Minnesota Statutes, sections 477A.11 to 477A.145, the land 
 17.6   status changes are effective for payments made in calendar year 
 17.7   2001 and thereafter.  Section 5 is effective the day following 
 17.8   final enactment.
