A bill for an act
relating to local government aid; making modifications related to public safety;
withholding local government aid from a city that reduces the number of peace
officers; proposing coding for new law in Minnesota Statutes, chapter 477A.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) For the purposes of this section, the terms in this
subdivision have the meanings given them.

(b) "City" means a statutory or home rule charter city.

(c) "Identified city" means a city that adopts a budget that provides for fewer peace
officers than provided in the budget the city adopted for 2020.

(d) "Peace officer" has the meaning given in section 626.84, subdivision 1, paragraph
(c).

By February 1, 2021, and annually thereafter, a city must certify
to the state auditor the number of peace officers provided in the budget the city adopted for
2020 and the number of peace officers provided in the city's most recently adopted budget.
The state auditor must determine the form and manner of the certification. By March 15,
2021, and annually thereafter, the state auditor must certify to the commissioner (1) a list
of cities that certified under this subdivision, and (2) a list of identified cities.

Notwithstanding any other law to the contrary, beginning with
aids payable in 2021, an identified city or a city that did not certify as required under
subdivision 2 is ineligible for local government aid under sections 477A.011 to 477A.03.
Any aid reductions under this subdivision must cancel to the general fund and not be
reallocated among other cities.
