A bill for an act
relating to health care; creating a demonstration project to allow county-based
purchasing plans to sell health plans in the individual and small group markets;
proposing coding for new law in Minnesota Statutes, chapter 62Q.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

PROJECT.

new text begin Projects allowed. new text end

new text begin (a) The commissioner of health may establish
demonstration projects to allow county-based purchasing plans to sell health insurance
coverage in the individual and small group health insurance markets.

new text begin (b) For purposes of this section, a county-based purchasing plan must meet the
requirements in section 256B.692, subdivision 2, unless waived by the commissioner.

new text begin (c) The commissioner shall have all enforcement and rulemaking powers available under
section 256B.692, subdivision 2, with respect to the county-based purchasing plans
participating in the demonstration project.

new text begin If a county-based purchasing plan elects
to participate in the demonstration project, the plan must meet the essential health benefits
requirements under section 62Q.81; the requirements under this chapter; chapter 62D; and
chapter 62K, unless waived by the commissioner.

new text begin Application. new text end

new text begin A county-based purchasing plan electing to participate in a
demonstration project shall apply to the commissioner for approval on a form developed
by the commissioner. The application shall include the following:

new text begin (1) a statement identifying the geographic area that the project is designed to serve;
new text end

new text begin (2) a statement indicating whether any limits in enrollment will be necessary consistent
with Code of Federal Regulations, title 45, section 147.104;
new text end

new text begin (3) a description of the proposed project, including a statement projecting a schedule of
costs and benefits for the enrollee;
new text end

new text begin (4) reference to the sections of Minnesota Statutes and Department of Health rules, if
applicable, for which a waiver is requested, including evidence that unless waived, would
prohibit the operation of the demonstration project;

new text begin (5) evidence that another arrangement is available for assumption of full financial risk
if the fiscal solvency requirements of chapter 62D will not be met according to the schedule
under section 256B.692, subdivision 2; and

new text begin (6) other information the commissioner may reasonably require.

new text begin Consideration of application. new text end

new text begin (a) The commissioner shall approve, deny, or
refer back to the county-based purchasing plan for modification the application for a
demonstration project within 60 days of receipt from the county-based purchasing plan.

new text begin (b) The commissioner shall inform the chairs and ranking minority members of the
legislative committees with jurisdiction over health care policy and finance of any
applications received by the commissioner, the action taken by the commissioner on the
application, and any statutes or rules waived by the commissioner.

new text begin The commissioner may approve an application for a
demonstration project for a maximum of six years, with an option to renew.

new text begin Each county-based purchasing plan for which a demonstration
project is approved shall annually file a report with the commissioner summarizing the
project's experience. The report shall be on a form developed by the commissioner.

new text begin The commissioner may rescind approval of a demonstration
project if the commissioner makes a finding that the requirements of this section are not
being met, or if the commissioner finds that the project's operation is contrary to the
information contained in the approved application.

Sec. 2. new text begin WAIVER REQUEST.

new text begin The commissioner shall seek any federal waivers necessary to permit a county-based
purchasing plan to be offered as a qualified health plan through MNsure.
