  1.1                          A bill for an act
  1.2             relating to human services; designating certain 
  1.3             nursing facilities as metropolitan facilities for 
  1.4             purposes of medical assistance reimbursement; amending 
  1.5             Minnesota Statutes 2002, section 256B.431, by adding a 
  1.6             subdivision. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 256B.431, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 38.  [DESIGNATION OF AREAS TO RECEIVE METROPOLITAN 
  1.11  RATES.] For rate years beginning on or after July 1, 2003, 
  1.12  nursing facilities located in areas designated as metropolitan 
  1.13  areas by the federal Office of Management and Budget using 
  1.14  census bureau data shall be part of the metropolitan array for 
  1.15  purposes of calculating a median, determining a historical base 
  1.16  reimbursement rate, or otherwise establishing a statistical 
  1.17  measure of nursing facility payment rates, in order to:  
  1.18     (1) determine future rate increases under this section, 
  1.19  section 256B.434, or any other section; and 
  1.20     (2) establish nursing facility reimbursement rates for the 
  1.21  new nursing facility reimbursement system developed under Laws 
  1.22  2001, First Special Session chapter 9, article 5, section 35.
