1.1 A bill for an act 1.2 relating to corrections; amending the appropriation to 1.3 build a close-custody correctional facility of at 1.4 least 800 beds; providing that the new facility shall 1.5 be at custody level four; deleting certain 1.6 construction bid requirements; authorizing 1.7 construction of an access road; amending Laws 1996, 1.8 chapter 463, section 16, subdivision 3. 1.9 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.10 Section 1. Laws 1996, chapter 463, section 16, subdivision 1.11 3, is amended to read: 1.12 Subd. 3. New Facility 89,000,000 1.13 To complete design and to construct, 1.14 furnish, and equip a new close-custody 1.15 correctional facility at custody level 1.16 four to provide at least 800 beds. 1.17The commissioner of administration1.18shall develop a design alternative to1.19bid and construct one of the six1.20residential pods at the new facility to1.21accommodate two inmates per cell. This1.22would result in a total of 680 single1.23occupancy close-custody cells, and 1361.24medium-custody double occupancy cells.1.25 The commissioner of administration may 1.26 use construction delivery methods as 1.27 may be appropriate to minimize the cost 1.28 of the facility and maximize the 1.29 construction time savings. 1.30 Before final contract documents for 1.31 this project are advertised for 1.32 construction bids, the commissioners of 1.33 administration and corrections shall 1.34 certify to the chairs of the senate 1.35 finance committee, the senate crime 1.36 prevention finance division, the house 1.37 ways and means committee, the house 1.38 judiciary finance committee, and the 2.1 house capital investment committee that 2.2 the program scope of the project has 2.3 not increased since the project budget 2.4 was reviewed in accordance with 2.5 Minnesota Statutes, section 16B.335. 2.6Upon receipt and evaluation of2.7construction bids and before awarding2.8contracts for the construction phase of2.9the project, the commissioner of2.10administration shall provide the bids2.11and evaluation to the chairs of the2.12senate finance committee and the house2.13ways and means committee and the chairs2.14of the policy committees and finance2.15divisions having jurisdiction over2.16criminal justice policy. Within 142.17days after receiving them, the chairs2.18shall advise the commissioner on which2.19design should be constructed.2.20If the chairs advise the 952-bed2.21option, but the legislature does not2.22appropriate by April 15, 1997, any2.23additional money that may be needed to2.24complete the project with that option,2.25the commissioner shall award the bids2.26for the 800-bed single-cell2.27close-custody facility in order to2.28avoid delays that would further2.29escalate the cost of the project.2.30 Upon receipt and evaluation of 2.31 construction bids and before awarding 2.32 contracts for the construction phase of 2.33 the project, the commissioners of 2.34 administration and finance shall inform 2.35 thesame committeechairs of the house 2.36 ways and means committee and the senate 2.37 human resources finance committee and 2.38 the chairs of the house and senate 2.39 policy and finance committees and 2.40 divisions having jurisdiction over 2.41 criminal justice issues of the project 2.42 budget necessary to complete that 2.43 portion of the project. Any portion of 2.44 this appropriation that exceeds the 2.45 project budget shall be unallotted by 2.46 the commissioner of finance. 2.47 By February 1 of each year, the 2.48 commissioner shall report to the chairs 2.49 of the house judiciary committee and 2.50 senate crime prevention committee on 2.51 efforts to recruit a workforce for the 2.52 correctional facility that is 2.53 proportional to the protected groups in 2.54 the inmate population, the results of 2.55 the efforts, and recommendations for 2.56 achieving the goal of proportional 2.57 representation of protected class 2.58 employees in relation to the inmate 2.59 population. 2.60 The commissioner of corrections shall 2.61 construct an access road from state 2.62 trunk highway 361 to the parking lot of 2.63 the correctional facility. 2.64 Sec. 2. [EFFECTIVE DATE.] 3.1 Section 1 is effective the day following final enactment.
