  1.1                          A bill for an act 
  1.2             relating to higher education; changing the 
  1.3             requirements for tuition reciprocity; amending 
  1.4             Minnesota Statutes 2003 Supplement, section 136A.08, 
  1.5             subdivision 3.  
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2003 Supplement, section 
  1.8   136A.08, subdivision 3, is amended to read: 
  1.9      Subd. 3.  [WISCONSIN.] A higher education reciprocity 
  1.10  agreement with the state of Wisconsin may include provision for 
  1.11  the transfer of funds between Minnesota and Wisconsin.  If this 
  1.12  provision is included, the amount of funds to be transferred 
  1.13  shall be determined according to a formula which is mutually 
  1.14  acceptable to the office and a duly designated agency 
  1.15  representing Wisconsin.  The formula shall recognize differences 
  1.16  in tuition rates between the two states and the number of 
  1.17  students attending institutions in each state under the 
  1.18  agreement.  Any payments to Minnesota by Wisconsin shall be 
  1.19  deposited by the office in the general fund of the state 
  1.20  treasury.  The amount required for the payments shall be 
  1.21  certified by the director of the office to the commissioner of 
  1.22  finance annually.  Notwithstanding the provisions of the 
  1.23  reciprocity agreement, the tuition surcharge that is assessed 
  1.24  Wisconsin students attending the Duluth campus of the University 
  1.25  of Minnesota shall be the same as the tuition surcharge assessed 
  2.1   Wisconsin students attending the Twin Cities campus of the 
  2.2   University of Minnesota. 
  2.3      Sec. 2.  [EFFECTIVE DATE.] 
  2.4      Section 1 is effective July 1, 2004.
