  1.1                          A bill for an act 
  1.2             relating to Washington county; requiring disclosure of 
  1.3             the Baytown special well construction area and its 
  1.4             construction code before real property sales and 
  1.5             development within that area. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [BAYTOWN SPECIAL WELL CONSTRUCTION AREA.] 
  1.8      (a) Notwithstanding other law, owners of real property in 
  1.9   the Baytown special well construction area of Washington county 
  1.10  and realtors and developers who list, show, offer for sale, or 
  1.11  develop the real property must disclose to all prospective 
  1.12  buyers of the real property: 
  1.13     (1) that the real property is located within the Baytown 
  1.14  special well construction area and is subject to the state's 
  1.15  special well construction codes; and 
  1.16     (2) the status of potable water test results of all 
  1.17  existing private water wells within the real property parcel and 
  1.18  the status with respect to compliance with the codes of each 
  1.19  water well within the parcel. 
  1.20     (b) Notwithstanding other law, a deed to real property in 
  1.21  the Baytown special well construction area presented for filing 
  1.22  and recording or registration must contain a statement on its 
  1.23  face to the effect that the real property described in the deed 
  1.24  is within the area and subject to the state's special well 
  1.25  construction codes for the area.
