  1.1                          A bill for an act
  1.2             relating to crime; increasing sentences for persons 
  1.3             who commit felonies for the benefit of a criminal 
  1.4             gang; repealing the statutory definition of criminal 
  1.5             gang; amending Minnesota Statutes 1996, section 
  1.6             609.229, subdivision 3; repealing Minnesota Statutes 
  1.7             1996, section 609.229, subdivision 1. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 609.229, 
  1.10  subdivision 3, is amended to read: 
  1.11     Subd. 3.  [PENALTY.] (a) If the crime committed in 
  1.12  violation of subdivision 2 is a felony, the statutory maximum 
  1.13  for the crime is three years longer than the statutory 
  1.14  maximum court shall sentence the defendant to an executed prison 
  1.15  sentence equal to at least twice the length of the presumptive 
  1.16  sentence under the sentencing guidelines for the underlying 
  1.17  crime. 
  1.18     (b) If the crime committed in violation of subdivision 2 is 
  1.19  a misdemeanor, the person is guilty of a gross misdemeanor. 
  1.20     (c) If the crime committed in violation of subdivision 2 is 
  1.21  a gross misdemeanor, the person is guilty of a felony and may be 
  1.22  sentenced to imprisonment for not more than one year and a day 
  1.23  or to payment of a fine of not more than $5,000, or both. 
  1.24     Sec. 2.  [REPEALER.] 
  1.25     Minnesota Statutes 1996, section 609.229, subdivision 1, is 
  1.26  repealed. 
  2.1      Sec. 3.  [EFFECTIVE DATE.] 
  2.2      Sections 1 and 2 are effective July 1, 1997, and apply to 
  2.3   crimes committed and acts committed on or after that date.
