  1.1                          A bill for an act 
  1.2             relating to waste management; providing authority for 
  1.3             the western Lake Superior sanitary district to collect 
  1.4             solid waste management service charges; amending 
  1.5             Minnesota Statutes 1996, section 115A.554; proposing 
  1.6             coding for new law in Minnesota Statutes, chapter 458D.
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 115A.554, is 
  1.9   amended to read: 
  1.10     115A.554 [AUTHORITY OF SANITARY DISTRICTS.] 
  1.11     A sanitary district has the authorities and duties of 
  1.12  counties within the district's boundary for purposes of sections 
  1.13  115A.0716; 115A.46, subdivisions 4 and 5; 115A.48; 115A.551; 
  1.14  115A.552; 115A.553; 115A.919; 115A.929; 115A.93; 115A.96, 
  1.15  subdivision 6; 115A.961; 116.072; 375.18, subdivision 14; 
  1.16  400.08, except subdivision 4, paragraph (b); 400.16; and 400.161.
  1.17     Sec. 2.  [458D.111] [COLLECTION OF SOLID WASTE MANAGEMENT 
  1.18  SERVICE CHARGES.] 
  1.19     Subdivision 1.  [AUTHORITY.] The board shall have the 
  1.20  powers of a county as specified in section 400.08. 
  1.21     Subd. 2.  [METHOD OF COLLECTING CERTAIN SERVICE 
  1.22  CHARGES.] The board shall determine the method of collecting 
  1.23  service charges in a service area by resolution. 
  1.24     Subd. 3.  [SERVICE CHARGES ON REAL ESTATE INCLUDING EXEMPT 
  1.25  PROPERTY.] In addition to any methods provided in section 
  1.26  400.08, the board may assess and collect service charges as 
  2.1   follows.  On or before October 15 of each year, the board shall 
  2.2   certify to each county auditor the solid waste management 
  2.3   service charge and a description of the lands against which the 
  2.4   charges arise.  It shall be the duty of the county auditors to 
  2.5   extend the charges upon the tax roles of the county for the 
  2.6   taxes of the year in which the charge is filed.  The solid waste 
  2.7   management service charge shall be enforced and collected in the 
  2.8   manner provided for the enforcement and collection of real 
  2.9   property taxes in accordance with the provisions of chapter 
  2.10  275.  The charges, if not paid, shall become delinquent and 
  2.11  subject to the same interest and penalty provisions as found in 
  2.12  chapter 276.
