A bill for an act
relating to health; proposing an amendment to the Minnesota Constitution, article
XIII, by adding a section, providing for freedom of choice in health care.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

An amendment to the Minnesota Constitution is proposed to the people. If the
amendment is adopted, a section shall be added to article XIII, to read:

Because all people should have the right to make decisions about their health
care, no law shall be passed that restricts a person's freedom of choice of private health
care systems or private plans of any type. No law shall interfere with a person's or entity's
right to pay directly for lawful medical services, nor shall any law impose a penalty or
fine, of any type, for choosing to obtain or decline health care coverage or for participation
in any particular health care system or plan.

The proposed amendment must be submitted to the people at the 2008 general
election. The question submitted must be:

"Shall the Minnesota Constitution be amended to state that because all people

If the constitutional amendment proposed in section 1 is approved by the people
at the 2010 general election, the legislature and the governor must enact legislation to
implement the constitutional amendment by July 1, 2011.
