A bill for an act
relating to capital investment; appropriating money for flood hazard mitigation
grants; authorizing the sale and issuance of state bonds.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin (a) $17,000,000 is appropriated from the bond
proceeds fund to the commissioner of natural resources for the state share of flood hazard
mitigation grants for publicly owned capital improvements to prevent or alleviate flood
damages under Minnesota Statutes, section 103F.161. Community levee projects, to
the extent practical, shall meet the state standard of three feet above the 100-year flood
elevation.

new text begin (b) Project priorities shall be determined by the commissioner, as appropriate, based
on need and consideration of available leveraging of federal, local, and state funds.

new text begin (c) This appropriation includes money for the following county and municipal
projects as prioritized by the commissioner: Ada, Afton, Austin, Borup, Browns Valley,
Climax, Delano, Golden Valley, Halstad, Hawley, Hendrum-2, Inver Grove Heights,
Melrose, Montevideo, Newport, Nielsville, Oakport Township, Ortonville, Oslo, Perley-2,
St. Michael, and St. Vincent.

new text begin (d) This appropriation includes money for the following watersheds: Big Lake,
Redpath, Brandrup 9, Western 32, Bois de Sioux Watershed District; Cedar River
Watershed District; Little McDonald-Kerbs-Paul Lakes Lake Improvement District;
Roseau Wildlife Management Area, Roseau Lake Bed, Beltrami, Roseau River Watershed
District; Klondike, Two Rivers Watershed District; Four Legged Lake, Pine Lake, Red
Lake Watershed District; Goose Prairie, Green Meadow, Wild Rice River Corridor, Wild
Rice River Watershed District; Tamarac, Middle Snake Tamarac Watershed District;
Humboldt, Wolverton Creek, Upper South Branch Buffalo, Barnesville, Sabin, Buffalo
Red Watershed District; and Shellrock River Watershed District.

new text begin (e) For any project listed in this subdivision that the commissioner determines is not
ready to proceed or does not expend all the money allocated to it, the commissioner may
allocate that project's money to a project on the commissioner's priority list.

new text begin (f) To the extent that the cost of a project exceeds two percent of the median
household income in the municipality multiplied by the number of households in the
municipality, this appropriation is also for the local share of the project.

new text begin (g) The Oakport Township project has fully met the two percent median household
income match requirements and no further local match is required to complete the project.

new text begin (h) Revenue received by watershed districts for agricultural operations within a
project area shall be retained in a separate watershed district project-specific operation,
maintenance, and replacement account and used solely for those purposes at the project
from which the revenue was generated.

new text begin To provide the money appropriated in this section from the
bond proceeds fund, the commissioner of management and budget shall sell and issue
bonds of the state in an amount up to $17,000,000 in the manner, upon the terms, and with
the effect prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, and by the
Minnesota Constitution, article XI, sections 4 to 7.
