  1.1                          A bill for an act 
  1.2             relating to human services; extending the deadline for 
  1.3             commencing construction for previously approved 
  1.4             moratorium projects; providing for expired and 
  1.5             canceled proposals; amending Minnesota Statutes 2002, 
  1.6             section 144A.073, by adding subdivisions. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2002, section 144A.073, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 10.  [EXTENSION OF APPROVAL OF MORATORIUM EXCEPTION.] 
  1.11  Notwithstanding subdivision 3, the commissioner of health shall 
  1.12  extend project approval for an additional 18 months for any 
  1.13  proposed exception to the nursing home licensure and 
  1.14  certification moratorium if the proposal was approved under this 
  1.15  section between July 1, 2001, and June 30, 2003. 
  1.16     Sec. 2.  Minnesota Statutes 2002, section 144A.073, is 
  1.17  amended by adding a subdivision to read: 
  1.18     Subd. 11.  [FUNDING FROM EXPIRED AND CANCELED PROPOSALS.] A 
  1.19  facility that is approved for an exception under this section 
  1.20  that determines that it will not commence construction prior to 
  1.21  expiration of the approval for the project is required to notify 
  1.22  the commissioner of health that the facility will not commence 
  1.23  construction prior to the expiration.  A facility that is 
  1.24  approved for an exception under this section that does not 
  1.25  commence construction prior to expiration of the approval for 
  1.26  the project is required to notify the commissioner of health 
  2.1   that the facility did not commence construction prior to 
  2.2   expiration.  For projects approved for an exception under this 
  2.3   section after June 30, 2001, the estimated annual state cost to 
  2.4   medical assistance for a project shall be considered not 
  2.5   encumbered and shall carry forward and be available for the 
  2.6   issuance of a new moratorium round in that biennium or the 
  2.7   following biennium if: 
  2.8      (1) the approval of the proposal has expired and the 
  2.9   facility has transmitted a letter to the commissioner of health 
  2.10  stating that the facility did not commence construction prior to 
  2.11  the expiration of the approval; or 
  2.12     (2) the commissioner of health received a letter from the 
  2.13  facility dated prior to expiration of the approval that stated 
  2.14  the facility's decision not to proceed with the project.
