1.1 A bill for an act 1.2 relating to corrections; amending the appropriation to 1.3 build a close-custody correctional facility of at 1.4 least 800 beds; providing that the new facility shall 1.5 be at custody level four; deleting certain 1.6 construction bid requirements; authorizing 1.7 construction of an access road; requiring trunk 1.8 highway improvements; designating county state-aid 1.9 highway; prohibiting certain designations; amending 1.10 Minnesota Statutes 1996, section 162.02, by adding a 1.11 subdivision; Laws 1996, chapter 463, section 16, 1.12 subdivision 3. 1.13 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.14 Section 1. Minnesota Statutes 1996, section 162.02, is 1.15 amended by adding a subdivision to read: 1.16 Subd. 7a. [PROHIBITION AGAINST CERTAIN DESIGNATIONS.] 1.17 Notwithstanding section 3, a county must follow the procedures 1.18 established in chapter 162 for the establishment and designation 1.19 of a county state-aid highway. 1.20 Sec. 2. Laws 1996, chapter 463, section 16, subdivision 3, 1.21 is amended to read: 1.22 Subd. 3. New Facility 89,000,000 1.23 To complete design and to construct, 1.24 furnish, and equip a new close-custody 1.25 correctional facility at custody level 1.26 four to provide at least 800 beds. 1.27The commissioner of administration1.28shall develop a design alternative to1.29bid and construct one of the six1.30residential pods at the new facility to1.31accommodate two inmates per cell. This1.32would result in a total of 680 single1.33occupancy close-custody cells, and 1361.34medium-custody double occupancy cells.2.1 The commissioner of administration may 2.2 use construction delivery methods as 2.3 may be appropriate to minimize the cost 2.4 of the facility and maximize the 2.5 construction time savings. 2.6 Before final contract documents for 2.7 this project are advertised for 2.8 construction bids, the commissioners of 2.9 administration and corrections shall 2.10 certify to the chairs of the senate 2.11 finance committee, the senate crime 2.12 prevention finance division, the house 2.13 ways and means committee, the house 2.14 judiciary finance committee, and the 2.15 house capital investment committee that 2.16 the program scope of the project has 2.17 not increased since the project budget 2.18 was reviewed in accordance with 2.19 Minnesota Statutes, section 16B.335. 2.20Upon receipt and evaluation of2.21construction bids and before awarding2.22contracts for the construction phase of2.23the project, the commissioner of2.24administration shall provide the bids2.25and evaluation to the chairs of the2.26senate finance committee and the house2.27ways and means committee and the chairs2.28of the policy committees and finance2.29divisions having jurisdiction over2.30criminal justice policy. Within 142.31days after receiving them, the chairs2.32shall advise the commissioner on which2.33design should be constructed.2.34If the chairs advise the 952-bed2.35option, but the legislature does not2.36appropriate by April 15, 1997, any2.37additional money that may be needed to2.38complete the project with that option,2.39the commissioner shall award the bids2.40for the 800-bed single-cell2.41close-custody facility in order to2.42avoid delays that would further2.43escalate the cost of the project.2.44 Upon receipt and evaluation of 2.45 construction bids and before awarding 2.46 contracts for the construction phase of 2.47 the project, the commissioners of 2.48 administration and finance shall inform 2.49 thesame committeechairs of the house 2.50 ways and means committee and the senate 2.51 human resources finance committee and 2.52 the chairs of the house and senate 2.53 policy and finance committees and 2.54 divisions having jurisdiction over 2.55 criminal justice issues of the project 2.56 budget necessary to complete that 2.57 portion of the project. Any portion of 2.58 this appropriation that exceeds the 2.59 project budget shall be unallotted by 2.60 the commissioner of finance. 2.61 By February 1 of each year, the 2.62 commissioner shall report to the chairs 2.63 of the house judiciary committee and 2.64 senate crime prevention committee on 2.65 efforts to recruit a workforce for the 2.66 correctional facility that is 3.1 proportional to the protected groups in 3.2 the inmate population, the results of 3.3 the efforts, and recommendations for 3.4 achieving the goal of proportional 3.5 representation of protected class 3.6 employees in relation to the inmate 3.7 population. 3.8 The commissioner of corrections shall 3.9 construct an access road from state 3.10 trunk highway 361 to the parking lot of 3.11 the correctional facility. The 3.12 commissioner of transportation shall 3.13 construct any necessary improvements at 3.14 the intersection of trunk highway 361 3.15 and the access road in order to 3.16 facilitate ingress to and egress from 3.17 the correctional facility. 3.18 Sec. 3. [COUNTY STATE-AID HIGHWAY.] 3.19 A county state-aid highway is established in Chisago county 3.20 beginning at the intersection of trunk highway 361 with the 3.21 access road to be constructed pursuant to section 2, and 3.22 continuing in an easterly direction to the parking lot of the 3.23 Rush City correctional facility. 3.24 Sec. 4. [EFFECTIVE DATE AND LOCAL APPROVAL.] 3.25 Section 2 is effective the day following final enactment. 3.26 Section 3 is effective the day after the commissioner of 3.27 corrections completes construction of the access road or the 3.28 governing body of the county of Chisago complies with Minnesota 3.29 Statutes, section 645.021, subdivision 3, whichever occurs later.
