1.1 A bill for an act 1.2 relating to the environment; modifying requirements 1.3 relating to certain environmental advisory councils; 1.4 amending Minnesota Statutes 1996, sections 115A.12; 1.5 and 473.803, subdivision 4; repealing Minnesota 1.6 Statutes 1996, section 473.149, subdivision 4. 1.7 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.8 Section 1. Minnesota Statutes 1996, section 115A.12, is 1.9 amended to read: 1.10 115A.12 [ADVISORY COUNCILS.] 1.11 (a) The director shall establish a solid waste management 1.12 advisory council, a hazardous waste management planning council,1.13 and amarket development coordinating council,prevention, 1.14 reduction, and recycling advisory council that are broadly 1.15 representative of the geographic areas and interests of the 1.16 state. 1.17 (b) The solid waste council shall have not less than nine 1.18 nor more than 21 members. The membership of the solid waste 1.19 council shall consist of one-third citizen representatives, 1.20 one-third representatives from local government units, and 1.21 one-third representatives from private solid waste management 1.22 firms. The solid waste council shall contain at least three 1.23 members experienced in the private recycling industry and at 1.24 least one member experienced in each of the following areas: 1.25 state and municipal finance; solid waste collection, processing, 1.26 and disposal; and solid waste reduction and resource recovery. 2.1 (c)The hazardous waste council shall have not less than2.2nine nor more than 18 members. The membership of the hazardous2.3waste advisory council shall consist of one-third citizen2.4representatives, one-third representatives from local government2.5units, and one-third representatives of hazardous waste2.6generators and private hazardous waste management firms.The 2.7 prevention, reduction, and recycling advisory council shall have 2.8 not less than nine nor more than 24 members. The membership 2.9 shall consist of one-third citizen representatives, one-third 2.10 representatives of government, and one-third representatives of 2.11 business and industry. The director may appoint nonvoting 2.12 members from other environmental and business assistance 2.13 providers in the state. 2.14 (d)The market development coordinating council shall have2.15not less than nine nor more than 18 members and shall consist of2.16one representative from the department of trade and economic2.17development, the department of administration, the pollution2.18control agency, Minnesota Technology, Inc., and the legislative2.19commission on waste management. The other members shall2.20represent local government units, private recycling markets, and2.21private recycling collectors. The market development2.22coordinating council expires June 30, 1997.2.23(e)The chairs of the advisory councils shall be appointed 2.24 by the director. The director shall provide administrative and 2.25 staff services for the advisory councils. The advisory councils 2.26 shall have such duties as are assigned by law or the director. 2.27 The solid waste advisory council shall make recommendations to 2.28 the office on its solid waste management activities. The 2.29hazardous wasteprevention, reduction, and recycling advisory 2.30 council shall make recommendations to the office onits2.31activities under sections 115A.08, 115A.09, 115A.10, 115A.11,2.32115A.20, 115A.21, and 115A.24policy, programs, and legislation 2.33 in pollution prevention, waste reduction, reuse and recycling, 2.34 resource conservation, and the management of hazardous waste. 2.35 Members of the advisory councils shall serve without 2.36 compensation but shall be reimbursed for their reasonable 3.1 expenses as determined by the director. The solid waste 3.2 management advisory council and thehazardous waste management3.3planningprevention, reduction, and recycling advisory council 3.4 expire June 30,19972001. 3.5 Sec. 2. Minnesota Statutes 1996, section 473.803, 3.6 subdivision 4, is amended to read: 3.7 Subd. 4. [ADVISORY COMMITTEE.] Each county shall establish 3.8 a solid waste management advisory committee to aid in the 3.9 preparation of the county master plan, any revisions thereof, 3.10 and such additional matters as the county deems appropriate. 3.11 The committee must consist of citizen representatives, 3.12 representatives from towns and cities within the county, and 3.13 representatives from private waste management firms. The 3.14 committee must include residents of towns or cities within the 3.15 county containing solid waste disposal facilities.Members of3.16the solid waste advisory committee established under section3.17473.149, subdivision 4, who reside in the county are ex officio3.18members of the county advisory committee.The director or the 3.19 director's appointee isana nonvoting ex officio member of the 3.20 committee. 3.21 Sec. 3. [REPEALER.] 3.22 Minnesota Statutes 1996, section 473.149, subdivision 4, is 3.23 repealed. 3.24 Sec. 4. [EFFECTIVE DATE.] 3.25 Section 1 is effective July 1, 1997.
