  1.1                          A bill for an act 
  1.2             relating to the environment; modifying requirements 
  1.3             relating to certain environmental advisory councils; 
  1.4             amending Minnesota Statutes 1996, sections 115A.12; 
  1.5             and 473.803, subdivision 4; repealing Minnesota 
  1.6             Statutes 1996, section 473.149, subdivision 4. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 115A.12, is 
  1.9   amended to read: 
  1.10     115A.12 [ADVISORY COUNCILS.] 
  1.11     (a) The director shall establish a solid waste management 
  1.12  advisory council, a hazardous waste management planning council, 
  1.13  and a market development coordinating council, reduction and 
  1.14  recycling advisory council that are broadly representative of 
  1.15  the geographic areas and interests of the state.  
  1.16     (b) The solid waste council shall have not less than nine 
  1.17  nor more than 21 members.  The membership of the solid waste 
  1.18  council shall consist of one-third citizen representatives, 
  1.19  one-third representatives from local government units, and 
  1.20  one-third representatives from private solid waste management 
  1.21  firms.  The solid waste council shall contain at least three 
  1.22  members experienced in the private recycling industry and at 
  1.23  least one member experienced in each of the following areas:  
  1.24  state and municipal finance; solid waste collection, processing, 
  1.25  and disposal; and solid waste reduction and resource recovery. 
  1.26     (c) The hazardous waste council shall have not less than 
  2.1   nine nor more than 18 members.  The membership of the hazardous 
  2.2   waste advisory council shall consist of one-third citizen 
  2.3   representatives, one-third representatives from local government 
  2.4   units, and one-third representatives of hazardous waste 
  2.5   generators and private hazardous waste management firms. The 
  2.6   reduction and recycling advisory council shall have not less 
  2.7   than nine nor more than 24 members.  The membership shall 
  2.8   consist of one-third representatives of businesses that generate 
  2.9   hazardous and solid waste; one-third representatives with 
  2.10  professional expertise in areas of pollution prevention, waste 
  2.11  reduction, reuse and recycling, resource conservation, and 
  2.12  economic development; and one-third representatives of citizens, 
  2.13  nonprofit organizations, and local governments.  The director 
  2.14  may appoint ex-officio members from other environmental and 
  2.15  business assistance providers in the state. 
  2.16     (d) The market development coordinating council shall have 
  2.17  not less than nine nor more than 18 members and shall consist of 
  2.18  one representative from the department of trade and economic 
  2.19  development, the department of administration, the pollution 
  2.20  control agency, Minnesota Technology, Inc., and the legislative 
  2.21  commission on waste management.  The other members shall 
  2.22  represent local government units, private recycling markets, and 
  2.23  private recycling collectors.  The market development 
  2.24  coordinating council expires June 30, 1997. 
  2.25     (e) The chairs of the advisory councils shall be appointed 
  2.26  by the director.  The director shall provide administrative and 
  2.27  staff services for the advisory councils.  The advisory councils 
  2.28  shall have such duties as are assigned by law or the director.  
  2.29  The solid waste advisory council shall make recommendations to 
  2.30  the office on its solid waste management activities.  The 
  2.31  hazardous waste reduction and recycling advisory council shall 
  2.32  make recommendations to the office on its activities under 
  2.33  sections 115A.08, 115A.09, 115A.10, 115A.11, 115A.20, 115A.21, 
  2.34  and 115A.24 to assist businesses and others in pollution 
  2.35  prevention, waste reduction, reuse and recycling, and resource 
  2.36  conservation.  Members of the advisory councils shall serve 
  3.1   without compensation but shall be reimbursed for their 
  3.2   reasonable expenses as determined by the director.  The solid 
  3.3   waste management advisory council and the hazardous waste 
  3.4   management planning reduction and recycling advisory council 
  3.5   expire June 30, 1997 2001. 
  3.6      Sec. 2.  Minnesota Statutes 1996, section 473.803, 
  3.7   subdivision 4, is amended to read: 
  3.8      Subd. 4.  [ADVISORY COMMITTEE.] Each county shall establish 
  3.9   a solid waste management advisory committee to aid in the 
  3.10  preparation of the county master plan, any revisions thereof, 
  3.11  and such additional matters as the county deems appropriate.  
  3.12  The committee must consist of citizen representatives, 
  3.13  representatives from towns and cities within the county, and 
  3.14  representatives from private waste management firms.  The 
  3.15  committee must include residents of towns or cities within the 
  3.16  county containing solid waste disposal facilities.  Members of 
  3.17  the solid waste advisory committee established under section 
  3.18  473.149, subdivision 4, who reside in the county are ex officio 
  3.19  members of the county advisory committee.  The director or the 
  3.20  director's appointee is an ex officio member of the committee. 
  3.21     Sec. 3.  [REPEALER.] 
  3.22     Minnesota Statutes 1996, section 473.149, subdivision 4, is 
  3.23  repealed. 
  3.24     Sec. 4.  [EFFECTIVE DATE.] 
  3.25     Section 1 is effective July 1, 1997.
