  1.1                          A bill for an act 
  1.2             relating to human services; barring a county welfare 
  1.3             agency from pursuing court action to obtain child 
  1.4             support in certain circumstances; amending Minnesota 
  1.5             Statutes 1994, section 256.87, by adding a subdivision.
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 256.87, is 
  1.8   amended by adding a subdivision to read: 
  1.9      Subd. 8.  [BAR FROM PURSUING COURT ACTION TO OBTAIN CHILD 
  1.10  SUPPORT.] The public agency responsible for maintenance 
  1.11  enforcement shall not pursue a court order to obtain child 
  1.12  support from a noncustodial father when: 
  1.13     (1) the mother is applying for AFDC; 
  1.14     (2) the child is more than five years old; 
  1.15     (3) the father has no knowledge of being the father at 
  1.16  least one year prior to the commencement of the court action; 
  1.17     (4) the father is supporting other children; and 
  1.18     (5) the father's income is less than 175 percent of the 
  1.19  federal poverty guidelines. 
  1.20     Sec. 2.  [EFFECTIVE DATE.] 
  1.21     Section 1 is effective retroactive to July 1, 1994.
